- No - you cannot have any contact with a Defendant - you must go through his attorney. If you are needing something from the employer, you can subpoena whatever records you need and you need to have the subpoena served by a certified process server for it to be proper service. Any other way and the employer can move to have the subpoena dismissed on ground of improper service and improper process of service.
- As long as you aren't a lawyer, you can send it to him wherever you want. The rules regarding contact with represented individuals only apply to lawyers and other represented individuals. However make sure you identify yourself correctly and do not impersonate a lawyer or any other official. If by chance you are a lawyer, you would already know this but, you cannot communicate directly with a person if they are represented or there is reason to believe they are represented.
