If you file bankruptcy do you have to give up your car even if you can still make the payment? I'm contemplating bankruptcy because my husband became unemployed and can't pay our mortgage and either can I since I have been paying the car payments and other bills to keep us surviving (water, electric, food, car payments, car ins. gas). If we file bankruptcy, but I'm still able to make the car payment can I keep the car or do I automatically lose the vehicle in the bankruptcy (Florida law). We are trying to get the bank to recalculate the mortgage at a lower affordable rate since my husband is working now. If that doesn't work we get the boot and rent somewhere...hopefully someone will rent to us with screwed credit. Now I know why people blow their brains out in these situations...its so frustrating and sad.

If I became too ill to work and my bills were more than my income, would I be able to file for bankruptcy? The bankruptcy rules have changed to make it harder to file. I've been thinking a lot, that if my current illness gets any worse, I may not be able to work or will have to take a leave from work. If that is the case, I will loose most of my income. Here is the question she think of want to move out of state but she have some debt on hand plus a house mortgage too. She though that if she file the bankruptcy first then sales her house she dun have to worry about all her debt anymore and she will keep the money of the house she going to put on market. How can I find out what assets are exempt from collections/judgments under Florida law? Hello, I have been googling and hunting all over the internet and am coming up empty handed. If anyone knows a web site where I can find out what assets are exempt from collections under Florida law, I'd appreciate knowing where to find that info. Please note this is not a bankruptcy question. I had a Ch. 7 bankruptcy six years ago and I can't do another one for at least two more years. In the meantime I have a lot of house-related credit card debt that I can't handle. I am already in pre-foreclosure and I am thinking of just letting the credit cards go. I do not want to file a Chapter 13 and have to be accountable to a trustee for every penny that goes in and out of my life for the next five years either.... I realize that if I let the credit cards go, I will probably get sued and have one or more judgments against me. I have five credit cards, total of $17k in debt, and one of the balances alone is $6k. I did find out that according to Florida law, because I am the head of household, I am exempt from getting my wages garnished. The only assets I'm worried about protecting are my eight year old Honda, and my bank account. I don't have any money in the bank account other than paychecks that go in and out. As I mentioned, I've been searching on the internet and can't find anything. I really need to know if I get sued by a credit card company, and if a judgment is made against me, if they would be able to seize my car and/or my bank account. BANKRUPTCY: Florida ( advise needed) I am a married women and I solely own my own business in Florida. My questions are: If I claim bankruptcy must my husband do the same? My mother-in-law may move in with us and she wants to give to us monthly her social security and pension checks for her support, etc., can this effect my filing for bankruptcy? I am aware that if I do file for bankruptcy I must also file same for my company and that I may not use any credit cards 3 months prior to filing. Florida law on security deposit? i am renting a house from Satan's mistress. she is the most miserable person i have ever came across. she is getting sued by an old business partner 4 1/2 mill and because of this she has filed bankruptcy and has listed all her rental property's including the one im living in. there is now a trustee of this house. so now i don't pay my rent to her anymore i pay it to the trustee. about 6 months ago my air conditioner wasn't working very good so i asked one of my neighbors (who is a licensed ac man) if he would fix what was wrong with the AC. i gave him the number to my landlord to call and work out the details ( i.e. what he was going to do and how much he would charge them). so they worked it out and he fixed it. it was something with the inside of the unit there was nothing wrong with the out side unit. so n e ways the house im living in is now going to be sold and someone came to inspect the house and found out that there was a loose power box switch ( amongst other things) that needed to be repaired. she called me today SCREAMING at me, and told me that i will be held responsible for that repair because i referred my neighbor to her. first of all he didn't even do anything to the outside unit he was mainly inside my house cleaning the AC. my niegbor said it was just a loose box that covers the power switch and it was no big deal. but how can she say i am responsible to fix it? i helped her by asking my neighbor to fix the unit in the first place hell, he only charged he $100 dollars. a regular company would of charged her $100 just to show up ! i have a feeling moving out of here is going to be a big headache ! does anyone know the laws in Florida regarding the process she or i have to follow to get my security deposit. im afraid she is strapped for cash and she's gunna try to stick it to me !! My HOA in Florida just file Bankruptcy for $3000 debt I have with them. Will I loose my Condo because of this? Back in November of 06 I missed 2 HOA payments because of financial distress. However I was able to make up these payments minus the $150 late charges that had been tacked on. Unfortunately I was never able to make up that $150 late fees, and although I was never late again on my regular HOA payment over the course of the year my late fees ballooned up to over $1k. I have tried to work things out with my HOA, but they insisted I need to pay all late fees at once to become current, which as I stated earlier I am unable to do. Since this time my HOA has acquired the services of a law firm to to retrieve the debt, and because of doing so my total fee is over $3000, and I now find myself in foreclosure. I am current on my Mortgage,a nd have been current for almost 2 years on my HOA (not including the late fees). I have a foreclosure date in a few weeks because of this, my question is can they take my home although they are not the primary lien holder, or does this just mean they will place a lien against my home in the amount that is owed, but I am allowed to stay in my home.. FLORIDA LAW-my wife got hit by a car while riding her bike on the sidewalk.? -my wife got hit by a car while riding her bike on the sidewalk. -we got a lawer to handle the case. -he got her going to a chiropractor -she was seen by an orthopedic surgeon and he found she had a torn miniscus -she wasnt on my car insurance because she doesnt drive, although she has a driver license for identification purposes. -the lady that hit her's insurance was geico and the we requested them to tender policy limits...which are $10,000 -they approved it and the release was executed. -the hospital bill one night came out to $24,000 -the 10 min visit to the orthopedic was $1,500.00 -the therapy for 3 1/2 mo was about $12,000 -MRIs are about another $1000 -and the lawer fee $3,333.33 -my insurance paid about $4,000 -unfortunately we do not have health insurance. -if we go after the lady that hit her, her only asset is a house that costs about $150,000 in the market right now. The lawyer suggested not to because the lady could just file for bankruptcy...she recently had forclosure on her home. I feel were getting ripped off. -I want to know what can be done so my wife is not in dept and her credit doesnt get destroyed...I feel our lawyer could care less what happens to us, he just wants his 1/3. the check for 10,000 came in from geico and he had us come in to sign it. He just played the cards for the insurance to pay, then for him to pay off himself and his recommended medical specialists and we get hardly no compensation for the pain my wife still suffers after accident and our lost wages? I would not want to work with this lawyer again because on several occasions he was nasty to me over the phone telling me my "case just sucks", and scolding me 'how could i not have health insurance for my wife?" Can I File a Law Suit Against a Hired Lawyer who did not file my bankruptcy on time? I hired a lawyer to file bankruptcy for my wife and I. She messed up a couple times and my wife was taken off and then she wasn't licensed in our area and then she told me she was going to have to let it cancel and refile in order to get my wife back on it. I asked her if we had time to see about selling our home to pay off all our debts before she refiled and she said yes we had 30 day. I asked her to refile when she had to so we would not loose our home. My father in law passed away and we had to go from Florida to NH and put my mother in law in a nursing home and close and empty their house. When we got back it was about 6:00 pm. We found out our house was being auctioned off the next morning and the courts and our lawyers office was closed. So I went the next morning to the court and filed a motion asking the court to delay the sale because our lawyer was suppose have filed our bankruptcy and hadn't and that we just returned the night before. The judge denied our motion and our home was sold and we had 24hrs to move out. When I got a hold of the lawyer she said she didn't refile because we had to pay her to. Were we paid her and she messed up can we sue her and if so how long do we have to find a lawyer that will sue another lawyer? We were gone almost a month and I thought they had to serve us papers in person!

Wage Garnishment-Not sure which state law would apply? Hi, I live in PA for 1 month now. I work for a company that has its headquarters in another state (i drive a truck OTR). I believe there will be some judgements for some debts I will not be able to have discharged in bankruptcy. Question-If i live in PA and work for a company based out of another state-which state wage garnishment law would apply? My home state or the employers home state? How can I protect my family from my terrible sister-in-law? Long story short: my brother married THE most selfish, self-centered, childish, tantrum-ing, BRAT of a woman. my entire family does NOT like her, and she has dragged my brother through the mud in so many ways. the first time our family even heard about her was when my brother said "here's my girlfriend...she's pregnant", then got married a couples years later, had another baby, bought a new-construction house (which they couldn't afford), immediately after had to file for bankruptcy, borrowed THOUSANDS of dollars from my parents, then faced foreclosure, and moved into my parents house RENT FREE, with their 2 children, and decided it would be a good time to have a third child...while still living at my parent's house, and after my brother quit his job! not only has this been a financial strain on my parents, but their COMPLETE lack of appreciation or help has now caused severe health risks to my father. recently, he was diagnosed with cancer, and their house has become so incredibly FILTHY!! (if you've ever seen the show "how clean is your house?", THAT'S how bad it is!!) well, i've decided that since my dad's first surgery is in a few weeks, and my parents are going to visit my GOOD brother in Florida for a week, it would be a good time for us all to get together and clean the house for my dad while they're away. it's an EXTREMELY big job, and we definitely need all the help we can get! MY husband (who works 3 jobs, and has also battled cancer), is fully willing to help out, but my sister-in-law, is more concerned with relaxing on her "days off", than rolling up her sleeves, and helping make the house better for my dad. (and when i say filthy, i'm talking MOLD, and MILDEW, and a slew of bacteria and diseases EVERYWHERE). with every suggestion i make, my brother keeps throwing up road blocks to try to wriggle out of helping or doing any REAL work! this is something that NEEDS TO BE DONE for my dad, and the job is WAAAY TOO big for me and my husband to do alone, so how to i encourage them to help, without COMPLETELY bitching them out? I received a court summons on August 3rd. in miami florida.? I am from Miami florida, and I know that the laws are different in every state. I am currently out of the country living in canada and this issue is regarding an old credit card with Capitol one of about 2200.00. Does anyone know what could happen if I dont attend to this summon and I get a judgment. what would happen? Can my bank account be frozen or wages be garnished in Canada? My girlfriend whom I have been livng with for over a year is a Canadian resident and citizen, is there a chance that they can put a lein on her assets in Canada? Why do the red states have the highest bankruptcy rates? IMHO, people who are ignorant about handling money and financial matters are the most likely to file bankruptcy (there are always exceptions such as financial hardships, emergencies, etc. But I'm just saying the preceding comment as a generality). People who are more aware and better educated about handling money are obviously more likely to not become bankrupt. 14 states were in the red category. Among these were: Alabama, Arkansas, Georgia, Kentucky, Mississippi, Tennessee, and of course Utah. Six of these states have among the lowest rates of high school and college graduates in the nation, but Utah is an odd exception. Even though Utah has high education standards, I did find another demographic that Utah has in common with the other states. The majority of the population of Utah are part of an organization that has some of the most archaic moral standards in the nation. Utah consistently lags behind the rest of the country on racial equality and sex issues. I think the only reason Utah allowed women to vote so early was so the Mormons could get a larger bloc of votes to pass laws in its favor, etc. Alabama, Mississippi, Arkansas, Georgia, and Tennessee are other states that have displayed the same type of archaic views of morality and bigotry. On the opposite end of the spectrum, such states as Massachusetts, Connecticut, Maine, Iowa, Vermont, and New Hampshire were all included in the group of 11 states with the fewest bankruptcy filings. These states are also consistently among the most progressive in the nation in terms of moral issues. Some of these states have among the highest percentages of college graduates. And, these six states I mentioned are also the only six states in the nation, thus far, to pass laws in favor of same-sex marriage. Most of the states with the greatest population, and most diverse population base were in the middle rankings: California, New York, Florida, Pennsylvania, and Illinois included. This is evidence to me that there is a deep connection between ignorance, bigotry, and moral standards. The states that generally have a greater percentage of people of higher intelligence and education, are the states that handle money better and are more accepting of diverse moral ideals. The states with people of lower intelligence and education, are those states which are more likely to handle money poorly, and be more bigotted and intolerant of diverse views.

Foreclosure questions? I live in Florida and I just received a summons from my mortgage company and it says I have 20 days to respond. Does anyone know the process of foreclosure and can I still save my house with a loan modification? My bank isn't open today and I have so many questions if anyone know anything about the law here in Florida or the time I have I would really appreciate the feedback. What is a "procedural issue?"? What is a "procedural issue" in a court of law? For instance, can a District Court in the State of New Mexico order a Plaintiff from Florida in a civil lawsuit to reopen a bankruptcy that was closed in 2005 from a Florida federal court? Once again -- a solution for the economic doldrums? New projections show little recovery despite the bailouts and stimulus directed toward the banks and corporations, nor do propositions for tax-breaks seem to offer much. Banks in particular seem to have returned to their carpetbagging, raising interest rates and lowering available credit, while continuing to give bonuses and golden parachutes to their executives. Meanwhile, news reports say retailers are already desperately cutting prices to try and bolster holiday sales. In Miami where I live (and am facing bankpruptcy), every week sees new exposures of felony corruption in government, while the State has ingeniously disguised what I would estimate as a 30% real unemployment rate by simply closing all the unemployment offices. I filed online (the only method) and received a refusal of benefits letter which said "...the State of Florida has no record of your qualifying employment...". Of course not. I worked in New York last year. I followed the recorded message after waiting half an hour, only to be given another 800 number which in turn gives another message after another half-hour wait: "Due to the volume of calls, we are unable to take your call at this time. (*Click*)." A dozen tries like that and I realized I was facing a brick wall. SO HERE IS MY SUGGESTION. If the problem is indeed getting money into the public's hands as the experts say -- why not circumvent the banks? Take those people like myself who fell victim to the banks' usurious practices of selling "debt-equity" to one another and charging arbitrary and stratospheric interest rates (mine are as high a 31.4%). Select those who have repaid the principle, say, 3 times over as I have -- and make those debts amnestied by law, either permanently or for a period of time like the eighteen months that the banks were allowed to continue their practices which will become illegal in February of 2010. Or even six months! In my case, that would give me $600 each month to put directly back into the enconomy -- and I am sure there are millions like me. Please, abstain for calling me an idiot for borrowing money at 30% as has happened when I offered this idea in the past. My loans were not "introductory rates" that expired, but fixed-rate below 10% that were sold from one bank to another which set new rates as allowed by the small print in the credit-card agreement; a practice which is now illegal under the law. The most onerous of these was Chase, which took over my card and account when it was gifted all of WAMU's assets by the FDIC. Thus, Chase has collected from me for the last 18 months on a debt for which it paid nothing, and meanwhile paid THEIR bad debt though my taxes, as well as part of the recent $65M "retirement package" given the CEO of bank of America which also holds one of my notes.. That one originated at Suntrust, was sold to MBNA which raised the rate from 8% to 24.9%, and then on to B of A which raised it to 29.9%. I have been paying that one faithfully for 9 years, and -- once again, their bailout and their executives windfalls as well. That's about it. Now on disability, I can pay no more. So, 90 days delinquent, I am facing bankruptcy a age 60 as I said. Meanwhile Chase declared last-quarter profits of $3.47Bn, and harasses me daily for the $2K I "owe" them from WAMU, ruining my credit rating so badly I cannot even get a Christmas part-time at Macy's because of my poor FICO score. Like I said: amnesty the debt. Given the chance with the publicly supported bailout, the banks and brokers have not shown any indication they will rehabilitate. So why not give me, the consumer -- and people like me who have shown good faith by paying consistently over a long time -- a chance to do better? Hospital bill: $53k on uninsured senior. what are the best options? My father (a low income/self employed) had an emergency surgery at a non-profit Hospital in S. Florida (not a Hill-Burton). Although he is over 65 and has Medicare part B, but not part A (did not worked enough quarters) nor any other insurance. Recently the outrageous bill arrived: almost $53K (I suspect is about 400% overcharged). After an initial contact with the hospital's counselor, we are awaiting for a response to whether he is accepted by the Medicaid program (I don't think he is eligible, since his assets is over $6,000) or apply him to the hospital's program, which leaves us still afraid of the bill, as the hospital may discount only portion of it and leaving an evident overcharged balance to be paid. What are the options if he still end up with a huge bill other than payment plan? challenge the charges? consider bankruptcy? or joining a class action law suit? (yes, there is one). My landlord is becoming hostile? 3 months ago my family and i moved into a rental house. we signed a 1 year lease and have paid our rent till dec 1 of this year. after the first month we were issued foreclosure papers on the rental. the landlord lied to us and hasnt been paying the mortgage so we contacted a bankruptcy trustee and he said that since hes filing bankruptcy we are not obligated to pay rent because he is relinquishing the house to the bank and he no longer owns the property plus we are just throwing our money away. so we stopped paying as of DEC 1 and now the landlord has written a ridiculous eviction stating we are to leave immediately. we know our rights and its illegal for him to force us out with out taking it to the courts first but the real issue is he claims starting tomorrow he is going to destroy the shed we have our stuff in and the very large deck attached to the house and along with what ever he pleases. we called the police and they said that they can do nothing because its a civil matter. i want to know if we have rights and can he destroy the home we are not officially evicted from. i live in Tampa Florida so the laws may be different in other areas. we are not sure who to call or what to do. im at the point of ready to fight this guy tooth and nail to ensure that my family isnt living in a destroyed home. we are only 6 days late on rent and hes becoming very hostile. what can i do..pleas help...

What to do, No General Liability Insurance? I had a very small companion/sitter bus. up till January 2007. It was an S-Corp. In Dec. 2006 a worker accidentallyy dropped client from a hoyer lift because straps were not completely secured. Client suffered hairline fracture of hip and tibia. How should I handle situation with my mom? long? My husband and I moved in with my mom a few years ago we were down on our luck we had one child that lived with us and two that came every other weekend we helped out financially after 2nd month and she asked us to stay permanently cause it was easier on her. We stayed for 4 years but it was miserable my mom thought that I was her personal everything . My husband was offered job in Florida so we decided to move there we gave my mom three months notice cause she was spending money left and right and had to file bankruptcy and was on the verge of loosing house we were paying half of all the bills and she was making more than we were it was just that she spent every penny one QVC and Ebay and HSN that is not our fault . Credit Card Agreement? Ok long but need help. I had an equity loan in Florida that was paid three years ago with WAMU. Last year I called to inquire about a credit card so I could start my own business. The operator told me I was already approved at 4.7 for 150K. I said great. They sent me a credit card, with no credit card agreement. I used about 38K to start my business, and was making my payments on time perfectly. Then 3 months later, I get a letter stating I needed flood insurance on my home. I called and asked why because I live in the Mountains. They told me it was for my home in FL. I told them I sold that home and hey freaked out on me and demanded payment in full at once. They said they gave me the card based on the equity in the home,and it was an equity card, not a credit card. I told them the equity loan was paid in full at time of sale, and account was closed. How could they do this? They started to accuse me of fraud and said they would be contacting authorities. I told them, why not just switch the account over to a credit card and simply work things out this way. They refused and told me they would be seeking criminal charges. This freaks me out, I had to hire a criminal attorney for the first time in my life (which by the way, a good criminal attorney won't even talk to you for under 5K). Then I had to hire a credit attorney on top of that. All this stress caused me to have a heart attack and put me in the hospital. Finally WAMU admitted it was there error because they could not show any credit agreement in writing or verbally, so they offered to work out a payment plan. But by this time, because of my heart attack, and the attorney fees, my company went under, and I was broke so I decided to declare bankruptcy. I litterally just finished my credit counseling two weeks ago and awaiting my certificate. And my attorney was planning to file a law suite against WAMU for what they put me through. Now WAMU was seized by the FDIC, then purchased by JPMorgan. So, my quesiton is this. Since I can't sue WAMU now, and JPMorgan won't be able to provide a credit card agreement in writing or verbally or even verify the purchases because WAMU could only provide 1 for 800 dollars, can I have it dismissed? Should I go back to the credit attorney or deal continue to deal with the attorney who was preparing the law suite? I have all documents of communication between WAMU and my attorneys, and while this has been going on they still hit my credit score and have collection companies call me. Each time a collection company calls, I give them the name and phone number of my credit attorney and then they don't call back. But like a month later, another collection company does. Suggestions - who should handle this and will I have the option to sue anyone for their errors?

Two-part rent question? I am going to be renting out my 1600 sq. ft. ranch house. I was wondering first what kind of deposit I should require? I'm sure while there, they'll be glad to explain to their constituents why they need so much rest in a year in which they will work fewer than 80 days. The Republicans in Congress have little to brag about when they return home. And the Democrats have a lot of explaining to do, as well. Once the party of the New Deal, Fair Deal and Great Society, the party of working men and women, the Democrats are now buried as deeply in the pockets of their corporate masters as are the Republicans. The Democratic Party has played a major role in helping to pass legislation that is grossly injurious to middle-class Americans and their families. This Congress, Republican-led with complicit Democrats, has cut $13 billion in college-student aid, passed numerous free-trade agreements that threaten good-paying jobs and approved an unconscionable bankruptcy law written by credit-card companies that is nothing less than a federal government heel in the neck of American families bankrupted by catastrophic illness and crushing medical bills. In fact, 18 of the 44 Democrats in the Senate and 73 of the 201 Democrats in the House voted in favor of the creditor-friendly bankruptcy bill. They apparently either didn't bother to learn or didn't care that half of all bankruptcies are caused by the soaring medical bills that stem from unforeseen illnesses and injuries. The Democrats are also casting deciding votes on the so-called free-trade agreements that have allowed corporate supremacists to export American jobs to the cheapest sources of labor. Twenty-two House Democrats approved the recent Oman free-trade agreement, including 10 that had previously voted for the Central American Free Trade Agreement. CAFTA, which passed the House by only two votes at the midnight hour, opened up to American businesses a market about the size of New Haven, Connecticut. And Democrats in the Senate have embraced the wrongheaded policies of the Bush administration on border security and illegal immigration. Thirty-eight Democrats joined with the Senate Republican leadership to crush the Republican majority and pass the illegal-alien amnesty bill. Forty-two Democrats voted against legislation that would have built a border fence to stop the flow of illegal aliens and drugs across our borders. In fact, it was Democrat Christopher Dodd of Connecticut whose amendment was attached to the legislation that would require the U.S. government to consult with the Mexican government before building a fence along our southern border. Congressional Democrats are even more dismissive of the need for border security than the Senate Republicans. House Republicans have taken to calling the McCain-Kennedy amnesty bill the "Reid-Kennedy bill" because Minority Leader Harry Reid of Nevada and Sen. Ted Kennedy of Massachusetts shaped most of the legislation. The Democrats incredibly talk about illegal aliens as victims as they press for amnesty, yet not one has raised concerns for the true victims of corporate America's lust for cheap labor: American working men and women, taxpayers all. It was, after all, Sen. Reid who argued in 1993 that illegal aliens place "tremendous burdens" on this country's justice system, schools and social programs, stretching our federal wallet to the limit as a result of "illegal aliens getting welfare, food stamps, medical care and other benefits." What could possibly explain Sen. Reid's complete conversion on the issue? Surely not. And how about that firebrand advocate for the Democratic Party's traditions and values, Democratic National Committee Chairman Howard Dean? Once considered a presidential candidate with a refreshing vision for America, Dean now spends no time pursuing ideas and proposals that would help working men and women. Instead, he's devoting his time and energy begging for money at the same contribution slop trough as his opponents while hurling insults at Republicans and indulging in petty name-calling. Instead of articulating a vision and plan to help the United States win the war in Iraq, he said simply late last year, "The idea that the United States is going to win the war in Iraq is just plain wrong." And when Iraqi Prime Minister Nouri al-Maliki was to address a joint session of Congress, Dean called him an anti-Semite for criticizing Israel. The petulant DNC chairman outdid himself by comparing an inconsequential Republican congresswoman, Katherine Harris of Florida, to the rather consequential Joseph Stalin. The incomparable Howard Dean managed to do that while calling for an end to political divisiveness. The Democrats want to wrest control of Congress from Republicans, and they have a better than average opportunity to accomplish the feat. The next five weeks just might be a good time for frustrated, disgusted constituents to ask what it will take to elect a Congress willing to represent working men and women and their families. If you live in Florida or know exactly what the laws say for recording a phone conversation in the State of Floirda, please answer this question. I am being harrassed to the hilltop by a bill collector. I understand that they are just doing their job, but at the same time, they are going over the edge. I want to record this. Yesterday, when they called, I told them that they were being recorded. Their tone changed and they didn't cross the line. Are these some of the hidden 'costs' of Obamacare (per the Wall Street Journal?)? Here are some of the groups on the menu if anything like the existing Senate or House health plans become law: • Young people. If the government mandates that everyone must have health insurance, healthy young people will have to buy policies that don’t reflect the low risk they have of getting sick. The House and Senate bills do let insurers set premiums based on age, but only up to a 2-to-1 ratio, versus a real-world ratio of 5 to 1. This means lower prices for older (and wealthier) folks, but high prices for the young. “They’ll have sticker shock,” says Rep. Paul Ryan, ranking Republican on the Budget Committee. • Small Businesses. Employers who don’t provide coverage will have to pay a tax up to 8% of their payroll. Yet those who do provide coverage also have to pay the tax—if the law says their coverage is not “adequate.” Amazingly, even if a small business provides adequate insurance but its employees choose coverage in another plan offered through the government, the employer still must pay. • Health Savings Account (HSA) holders. Eight million Americans, according to the Treasury Department, are covered by plans with low-cost premiums and high deductibles that are designed for large, unexpected medical costs. Money is also set aside in a savings account to cover the deductibles, and whatever isn’t spent in one year can build up tax-free. Nearly a third of new HSA users, according to Treasury figures, previously had no insurance or bought coverage on their own. These policies will be severely limited. The Senate plan says a policy deemed “acceptable” must have insurance (rather than the individual) pay out at least 76% of the benefits. The House plan is pegged at 70%. That’s not the way these plans are set up to work. Ray Ramthun, who implemented the HSA regulations at the Treasury Department in 2003, says the regulations are crippling. “Companies tell me they could be forced to take products off the market,” he said in an interview. • Medicare Advantage users. Mr. Obama and Congressional Democrats want to cut back this program—care provided by private companies and subsidized by the government. Medicare Advantage grew by 15% last year; 10.5 million seniors, or 22% of all Medicare patients, are now enrolled. The program is especially popular with those in badly served urban areas and with those who can’t afford the premiums for Medicare supplemental (MediGap) policies. A total of 54% of Hispanics on Medicare have chosen Medicare Advantage, as have 40% of African-Americans, according to the Centers for Medicare and Medicaid Services at the Department of Health and Human Services. These plans tend to provide better coordinated and preventive care, and richer prescription drug coverage. But Democrats dislike Medicare Advantage’s private-sector nature, and they have some legitimate beefs with its unevenly generous reimbursement rates. This week Mr. Obama told the Washington Post that the program was “a prime example” of his efforts to cut Medicare spending, because he claims people “aren’t getting good value” from it. That’s not what others say. In January, Oregon’s Democratic Gov. Ted Kulongoski wrote the Obama administration expressing his concern about its efforts “to scale back Medicare Advantage” because the plans “play an important role in providing affordable health coverage.” He noted that 39% of Oregon’s Medicare patients had chosen Medicare Advantage, and that in “some of our Medicare Advantage plans . . . with proper chronic disease management for such conditions as heart disease, asthma and diabetes, hospitalization admission rates have declined.” The $156 billion in Medicare Advantage cuts over the next decade proposed by Mr. Obama will force many seniors to go back to traditional Medicare at greater expense. A new study for the Florida Association of Health Plans found that because Medicare Advantage plans have richer benefits and lower deductibles and copayments than traditional Medicare, seniors in that state would face dramatically higher payments if forced to give up their Medicare Advantage plans. Cost increases would range from $2,214 a year in Jacksonville to $3,714 a year in Miami. There are reasons that Blue Dog Democrats in Congress are leery of their party’s health-care reform plans. Many are in districts or states carried by John McCain, and they worry about the political fallout when these groups realize they will be paying for health-care reform. They also know that every government entitlement winds up becoming a money pit. In 1965, Sen. Allen Ellender (D., La.) dismissed promises that Medicare would be a modest program to save seniors from bankruptcy. “Let us not be so naïve as to believe that the Medicare program will not be increased from year to year to the point that the government will have to impose more taxes on the little man or else take the necessary money out of the Treasury,” he told colleagues. Ellender was right, and Ellender was right, and his warning is even more relevant in our era of skyrocketing deficits and Medicare costs. Illegal immigrants depressed wages in Arizona to the tune of $1.4 billion in 2006 and dipped lower-skilled legal workers’ pay by 4.7 percent. That is according to a study by a Harvard University economist commissioned by the Maricopa County Attorney’s Office. The MCAO had the study done as part of its defense of the state’s new employer sanctions law. Business and Hispanic groups have challenged that law questioning its validity and arguing it would hurt the state’s economy. The study by Harvard economist George Borjas said hiring illegal immigrants depresses wages because they work for lower pay and sometimes are paid under the table. The study said illegal immigrants primarily impact wages and jobs held by legal workers with lower education levels. Borjas said that illegals make up 10 percent of all state workers and decrease all wages by 1.5 percent. Before our last election for change: As the left proclaims that there will be a massive Latino voter turnout in 2008, more and more cities across the nation are claiming that they can’t stop voter fraud among illegal aliens. Both the Pew Hispanic Center and Center for Immigration Studies rank Arizona fifth and put its illegal immigrant population at about 500,000, or 9 percent of all state residents. Arizona led the nation in another category that may be tied to illegal immigration: one in 12 drivers in fatal accidents had no license at all. New Mexico and Texas, two other border states, ranked second and third in that measure. Arizona’s high rates of unlicensed drivers and hit-and-run crashes are “joined at the hip,” said Dave Willis, a senior research scientist at the Texas Transportation Institute who has studied traffic safety issues for 30 years. Gustavo Soto, a supervisory agent with the Border Patrol’s Tucson Sector, said smugglers of illegal immigrants or illegal drugs often are involved in fatal hit-and-runs in this part of the state. “They’re driving reckless, and they’re driving in shoddy vehicles,” Soto said. We have to provide a ream of personal, financial, and military documentation just to get “in” the system. Once the information is validated then we are informed what our “share” of the medical expenses will be. If we submit the information in March, and we lose our job in April, we have to wait a full year for the VA to reassess our co-payment. With past funding cuts it is not unusual for a veteran to have to travel across several counties to reach a VA medical center. Meanwhile, the illegal simply presents himself to the nearest hospital for a complete smorgasbord of free medical services. This “squatter” enjoys all of the freedoms that the veteran has fought for, with none of the pain, suffering, or expenses associated with them… The Florida Hospital Association surveyed 28 hospitals and found that health care for illegal aliens totaled at least $40 million in 2002! So you can see this problem is nation wide! Illegal immigrants may not know much about medical care. But one thing they do know: they get a better deal in the U.S. than they do in Mexico. Illegal aliens have cost billions of taxpayer-funded dollars for medical services. Dozens of hospitals in Texas, New Mexico Arizona, and California, have been forced to close or face bankruptcy because of federally-mandated programs requiring free emergency room services to illegal aliens. Taxpayers pay half-a-billion dollars per year incarcerating illegal alien criminals. Immigration is a net drain on the economy; corporate interests reap the benefits of cheap labor, while taxpayers pay the infrastructural cost. Research shows “the net annual cost of immigration has been estimated at between “the net annual cost of immigration has been estimated at between $67 and $87 billion a year. The National Academy of Sciences found that the net fiscal drain on American taxpayers is between $166 and $226 a year per native household. Even studies claiming some modest overall gain for the economy from immigration ($1 to $10 billion a year) have found that it is outweighed by the fiscal cost ($15 to $20 billion a year) to native taxpayers.” 80% of cocaine and 50% of heroin in the U.S. is smuggled across the border by Mexican nationals. Drug cartels spend a half-billion dollars per year bribing Mexico’s corrupt generals and police officials, and armed confrontations between the Mexican army and U.S. Border Patrol agents are a real threat. How do I handle a family member who's a financial black hole? My problem is my dad. I can't send him money fast enough. My dad is 61 years old. He has lived with my grandma (his Mom), since 1983, after him and my mom split. He never got over the divorce. In his lifetime he has filed for bankruptcy twice. I think the total between the two was $75000. Last year, he convinced his mom to sell her house and move with him to Florida. He has had a retirement account since I think 1976, and that was a very nice retirement account. However, he was allowed to take money out of it and now that well is almost dry. Grandma got $80000 for her house. That was one year ago. The money is almost gone. I sent them a check today, and now I only have $157 left in my wallet, and I still need to buy food to last until my next pay period which is one week from today! In the past I had great success with investments, but investing can sometimes be a gamble. Last year, against my own judgment, Dad convinced me to let him loan me $9000 out of Grandma's bank account to invest the money for them and make them rich with it. I told him numerous times that it was possible to lose money that way, but he didn't listen. Instead of making money, I lost that money plus $10000 of my own money in investments. I decided to quit before I got even more behind. I make $50000 per year with my miserable job. I promised Grandma I would pay her back that money out of my own paychecks before the end of the year, plus $2000 as a gift, which I will do. I think that's only fair. That's not fast enough for my dad. I will pay this money to her by working at a job. However, I decided that after I pay off Grandma, they will never see money from me again. Right now, I'm not planning to talk to him again after I have the money paid back. Another problem is, job isn't in Dad's vocabulary. He's also a Seventh Day Adventist, and that's a Christian denomination that takes the 4th Commandment (prohibits working from sunset Friday to sunset Saturday) seriously. His objection to getting a job is that that would require him to break God's Laws. The Bible does say "six days you shall labor and on the seventh day you shall rest". He has the part about resting on the seventh day mastered. It's the part about "six days you shall labor" that seems to be a problem for him. He spends seven days a week relaxing by the pool or the beach. During this time, he gets stressed out about running out of his mom's money, but during that time, the idea of getting a job doesn't seem to enter his mind. Suggesting that would garner a very negative response from him, such as screaming or yelling. He's a financial black hole because money disappears below his event horizon. Like scientists who don't know what happens to the matter once it falls into a black hole, I don't know where the money goes! I'm sending Grandma money as fast as I can, but I had two emergencies of my own this month that cost a lot of money! What am I supposed to do about this??

Am I eligible for Chapter 7 or Chapter 13? I filed Bankruptcy in May of 2002 and I understand that the new law states you can file again only after 8 years now. I had a 65,000 /year job and I have been unemployed for the past year. The only jobs I have been able to recently obtain are $10 - $12 an hour in Tampa, Florida. Do I have any other options? Is chapter 13 an option since chapter 7 is not.
