How different is the new bankruptcy law from the old? I am considering filing bankruptcy due to the fact that in the last year i have willing foreclosed on my home and now it looks as though I am going to have to do the same with one of my cars, and I am just wondering if it wouldn't be better to file bankruptcy since my credit can't get any worse than what it already is, and that way I could have a chance at starting over fresh.
new bankruptcy.? can someone walk me through the steps of this new bankruptcy law. Also does anyone know of any alternatives? Im in real bad shape though. CC, med bills, IRS, State, Private school tuition, two vehicle payments, .... I went from making 6 figures to the medium 5 figures. Not on the street poor but definately cant maintain this lifestyle anymore.
New Bankruptcy Law Question.? filed bankrupsy back on 9/21/00. I need to file agian. When i did this then of course I nver thought i would be doing it agian, but anyway i was told then that I had to wait 6 years. Now my question is....if I did this 5 years before this new law passed then can I file it agian, and then the new new law applies or do i have to wait 8 years even though it was before the new law passed. This was a chapter 7. NOW another question...... If I cant do the chapter 7, will i be able to do chapter 13???
Has anyone had to file bankruptcy since the new law went into effect? I live in NY....and have had some unfortunate financial difficulties, and very well may have to file. I've looked into the debt settlement companies, but the monthly payments are not what I can work with. With the new law...can I reaffirm with my auto loan, and keep my house? Any advise given from previous experience will be greatly appreciated.
Can anyone give me the basics of this new bankruptcy law? I feel I'm drowning in debt and want to get my head above water. I went through a bad situation recently that caused me to get behind on credit cards and also to have to take out more credit just to survive... I've always been faithful and diligent about paying my bills and would hate to file bankruptcy but I don't see another option.... just wonder if any of you out there know what the new criteria is on filing.... Thanks how do I find out what the median income is in my area to see if I qualify to file Current income is around 40,000 annually and really i have about 16,000 in debt with just credit cards. I have some medical bills that are around 6000. I have a 2nd mortgage around 30,000 that I DONT want to file on. I also have four children and my bills each month take most of my income.
new bankruptcy law in pa? first off i am asking this question for a friend becasue she doesnt have a computer. my friend and her husban filed bankruptcy 2 years ago and now have gotten themselves into such a jam they are even deeper in debt rthan when they filed chapter 7 the first time they wanted to know if they could still file chapter 13 and get out and never use credit cards again
New bankruptcy law question? My husband just got a judgement against his former lawyer for $20,000, the amount he'd paid her when she supposedly represented him, because she didn't do anything she was supposed to in his child custody case, basically cost him his daughter, "forgot" to file motions, lost his paperwork, etc. He was awarded this in an arbitration from the Calif state bar a YEAR ago but she never paid a cent so it just got turned into a Judgement finally this week. Problem is another attorney who knows this Loser attorney says she's about to file for bankruptcy. Someone told us that she can't put things that have occurred in the last 6 months on her bankruptcy - is this true??? Once she files I'm afraid we'll never get a cent.
New Bankruptcy Laws and Salary limits? I am planning on filing Chapter 7 bankruptcy due to a failed business and a foreclosure on investment property. Total debt is 190K and my total household income for a family of 3 is also 190K. I am wondering if I am have too much income per the new bankruptcy laws. I would like to avoid chap 7 but I can not afford this additional debt. Please keep in mind the 190K is the debt for the failed business expenses. This does not include my actual debt which includes my current home, auto, living expenses, etc
Need some info on new bankruptcy laws? I've heard that with the new laws that you have to pay debt back with adjusted payments, also what's the difference between chapter 7 and 13? I've always had great credit but recently ran into some issues and trying to find out what all my options are. New Bankruptcy Laws question...? No, I am not looking to declare bankruptcy and I am not in any debt, except for under 200 dollars at Swiss Colony, which I am paying off. I am just curious to know, what the new bankruptcy laws mean, if, say, someone is in debt for 10 grand or 20 grand, for example, to store credit cards, like Sears, Macy's, Target, Victoria's Secret, etc., and VISA or Master Card. I know the new laws are in favor of the merchants. What does that mean, to people nowadays who go through bankruptcy? What do they have to pay?
New Bankruptcy Laws? My friend and his girlfriend have 1 car each both in his name, hers is a 1998 ford. They owe 2600. on it and it needs a windshield, brake work, transmission work, and it has some shorts in the wiring to the windows. He was told by his lawyer that he needs to make an evaluation and not reaffirm anything that could hurt him in the end. SO he knows that he needs to let this vehicle go as it need like 1300. in work to it and there is still no guarantee, but would he be breaking the law ig he got her a new one at buy here pay here lot and let this one go. In Bankruptcy law in what cases could student loans be included? I live in Ohio and my husband and I are filing bankruptcy. I was reading about bankruptcy laws and saw where it said that student loans could be included if the judge ruled that it would cause undue hardship. What does this mean, and when is it considered an "Undue hardship"

Are divorce law and bankruptcy law lucrative fields? I have heard that some some lawyers have made very good money in divorce law and/or bankruptcy law. They will advertise that they will "do" a divorce or bankruptcy for a few hundred dollars and then many people will call in for their services. I have also heard that divorces and bankruptcies are usually not too complicated. Any information would be great - I may be very misinformed.
I need help understanding bankruptcy law with a partnership HELP? In March 1988, Daniel E. Beren, John M. Elliot, and Edward, F. Mannino formed Walnut Street Four, a general partnership, to purchase and renovate an office building in Harrisburg, Pennsylvania. They borrowed more than $200,000 from Hamilton Bank to purchase the building and begin renovation. Disagreements among the partners arose when the renovation costs exceeded their estimates. When Beren was unable to obtain assistance from Elliot and Mannino regarding obtaining additional financing, the partnership quit paying its debts. Beren filed an involuntary petition to place the partnership into Chapter 7 Bankruptcy. The other partners objected to the bankruptcy filing. At the time of the filing, the partnership owed debts of more than $380,000 and had approximately $550 in the partnership bank account. Should the petition for involuntary bankruptcy be granted?
