california medical privacy act and collection agencies violation? As yet another american being punished for needing medical care by being buried in debt, I am trying to crawl out of it, however I was surprised to learn that a collection agency had detailed information about my medical information. Isn't it a violation of the privacy act for hospitals to provide medical information to debt collection agencies? Any info on this would be appreciated.
I need help writing a letter to the medical collection agencies...? My husband and I married Sept 05. Since then we have accumulated over 20k worth of unpaid medical bills. Some were from the delivery of our daughter. Most of them are from a illness he has. He was recenty diagnosed with acute pancriatitis. He went through many procedures prior to the final diagnosis. I would like to not pay any of the past due bills just out of frustration of it taking so long to diagnose him. We make good money for where we live but there is no way to pay these bills in full. I was advised to write each agency a letter and ask for a settlement. I am clueless on how to write it and how to ask, or even what to ask for. Huge intrest rates are accruing day by day. obviously the way i asked this question was incorrect. i am trying to pay off everyone of these debts. i do understand they are my problem. i am paying over 2100 a month in payments. i have the opportunity to pay them off, one by one, in cash. i am trying to cut down the interest on them and am requesting help with writing a settlement letter. I AM NOT TRYING TO BACK OUT OF PAYING THEM.
Collection Agencies - what do they pay for collection accounts from hospitals and medical offices? I am curious about the going rate for collection accounts especially medical bills. I don't want to know how much they make trying to collect I want to know what they pay for the right to try to collect.

Am I better off paying old medical bills directly to the doctors or to the collection agencies? I have some old medical bills that have gone to a collections agency. I have recently gotten into a position where I can pay the bills off, but should I pay the hospital & doctors directly or send the money to the collection agency? I would rather pay the doctors & hospital since I may need to use them again, but don't want to leave the old bills on my credit report. What is the best way to pay these bills?
Medical billing collection agencies? Hey, let me start off with my story. In the summer of 2008 I had my appendix(sp?) removed. It was in my name. My mother, however, offered to pay the bills. Being naive, I was like ok! However, I have recently discovered she hasnt started paying the bills until now, nearly a year later\. and I have a collection agency, or law attorneys, saying I owe 1400 dollars, generally. Now, It's my fault for not realizing this, and now my credit is in danger. Its damaged but it could get worse. Here is my question. im willing to pay these bills of course, but what is the best way of figuring out how much you owe> by calling the medical billing associates or by talking to the lawyers. and if I pay these bills, will my credit come through intact?
Do you know a contact number for this medical collection agency? I have an address for them, just no phone number. We need a phone number because we need faster responce then the mail will give us and we don't want to take a chance of them ignoring the mail too. National Hospital Collections PO Box 699 Morgantown, WV 26507 Do you have a number for this agency? Thanks, Belinda
I received a letter from american medical collection agency,? Does that mean it has been reported to Credit Bureaus?
What worst can happen to me from collection agency, for my unpaid medical expenses? 2 years ago, I had an auto accident, as a result I had incurred medical expenses. my Insurance(United Auto) do not want to pay it and I'm suing them. on the other hand, collection agencies are contacting me to pay the bill. to what extent can they harm me??
Is there any way to get medical collection accounts removed from my credit report? I have several medical accounts that have been sent to collections, I pay a monthly payment to the collection agency and then they credit that amount to the oldest account they have. My problem is that once each account has been paid in full it still shows up as a collection account and remains on my report. I am 24 years old and I am married and pregnant with my second child, we need a larger house and no one will loan to use because these collection accounts are killing my credit score. I just want to paid ones removed, but the agency wont do it. Is there any way around this?
Should I send a "collection proof" letter to medical collection agency? I have had some medical problems in the past few years and have had many medical bills. The largest bill is only about $2,000, but there are so many bills and we just don't have the money. I have been making small monthly payments until recently. Back in December my husbands company he worked for went under and he had to take a large pay cut at his new job. I am unable to work. Our current priority has been making sure we can pay for rent, food, and electric. Which also has been very difficult. One of the medical collection agencies is threating to sue and I read on a legal website to write a "collection proof" letter to the agency stating that I do not have any income, do not own real estate, or own personal property over $1,000, and my vehicle is under $1,000. Is this the best thing to do, or should I take some other sort of action? I'm not against paying the debt. I just can't right now and I don't know how long it will be until we are able to get back on our feet again.
I had a Medical Collection and paid the original creitor, but they paid the CA? I had a Medical Collection and paid the original creditor, but they paid the Collection Agency. The payment according to my bank account, was made to the OC. They paid the CA with it, and now i have a "paid collection". What recourse do i have?
I have medical bills sent to various collection agencies can I? Can I combine all of them with just one place so I can make one payment monthly? Is that possible? and how? where do I get info
Are collection agencies allowed to put medical bills on your credit report? I was always under the understanding that collection agencies were not allowed to put medical bills on your credit report. I just ordered a copy of my credit report today and found two bills under the "derogatory" section of my report. Both bills I have paid already and paid them within a month of receiving a letter from a collection agency. One was a co-pay for a visit to a therapist and another was a co-pay for a after hours clinic. One of them even still says that it's not paid when in fact it has been paid for a long time now! So what's the story, are these legit postings or not? Thanks in advance!
can a collection agency force you to pay a medical bill in full when you have been making monthly payments? Our hospital sold my wifes medical bill to a collection agency that sold it to another collection agency who is now demanding we pay in full right now. We have made payments on this bill every month since the beginning. Can they report to collections & garnish wages

I have an account at freecreditreport.com. So far, only one of my bills in collections is showing up...Have the rest not been reported yet?
Can I claim medical expenses as a deduction that have been paid through a collection agency? I had past due medical expenses that I couldn't afford to pay at the time. My wife and I were contacted by collection agencies wanting to collect. I set up a payment plan with one of them and have been paying them back for the past year. The other one I've paid back completely. Can I claim these as medical expenses on my taxes?
What can i do about Medical bill that are in collection? I am 6 months pregnant work part time and not one of these damn collection agencies will work with me. Sooo should i file for bankruptcy or hire a lawyer to help me work out payment plans with these guys?
I have medical accounts in monitoring by collection agency. They put it on my credit report as in collections? After contacting the hospital that put it with the collection agency, the hospital told them to remove it from collections. The company said they would write a letter to collection agencies saying it (was in monitoring only) this was Aug 17, 2009. They explained they only write these letters on the 1st of each month, which would of been Oct 1. As of today Oct 13, 2009 they have not done it. Any info out there ??? Help!!!! they are killing my credit score.
Are collection agencies required to notify you of accounts you hold with them? About two or three years ago, at age 18, I received a letter form a collection agency stating that a medical account that had gone into collections had been transfered to my credit report when I had turned 18 and that I owed them X amount of dollars. Being that I am a working student I didn't get around to paying off THAT particular bill until about a year ago. Upon paying the bill I was notified that I had 10 other accounts with them (all under $70). Between the 10 accounts, $400 interest had accrued! Aren't they required to inform me of ALL accounts I hold with them? I would have paid off the other accounts if I knew they even existed! Is it reasonable to ask them to eliminate the interest? Would it be reasonable to ask them to delete the information off of my credit report based on lack of knowledge of the accounts?
Medical bill forwarded to a collection agency? My husband passed away with a medical bill. I wasn't able to pay it in time and it got forwarded to a collection agency....from 150 dollars to 1700. What can I do about it?
Unknown medical bills went in to collection for more than a year? Recently caught my attention when I was applying for personal loan. The loan lady said that I am not qualified, cos there is negative item reflecting on my credit report. It's medical collection. I had never received bills from the medical group. It was about treatment provided to me since 2004! Now the over due debts had turned over to the collection agency, and they also had never sent me a bill for it. When I called the original creditor, they cannot handle my debts anymore. When I call the collection people up, all they want is the full payment without providing me more details on the debt. I was mad cos they ruin my credit behind my back without me knowing at all. Can anyone suggest if it's a good first step to dispute it with credit bureau first. I think, at least the Bureau can force them to dig in to more legitimate info about this debt before I pay.
Should I pay a collection agency for a medical procedure my insurance company claims they/I don't have to pay? Insurance co. issued documentation stating terms of provider's contract do not requirement payment by insurance co. or patient. Provider has hired a collection agency to collect even though I sent copy of insurance documentation to provider. What are my options?
do collection agency bills count as unsecured debt? For medical bills, credit cards, etc.? I want to consolidate my debt, but was told i couldn't because it wasn't unsecured debt. I have a credit card, and several collection agencies i owe for medical bills. Is that unsecured debt?
Trying to consolidate debt into one low monthly payment, but my debt is too low or with collection agencies? I have about $7,000 in debt with credit cards and medical bills that are with collection agencies. I have contacted several debt relief groups, but unfortunately they only work with people who have more than $10,000 in debt or they are unable to work with collection agencies.
How can I dispute a collection account arising from medical care incurred when I was struck by a car.? To my understanding, the insurance of the driver who hit me ( a pedestrian) is supposed to shoulder all these medical expenses. I have given the hospital my claim number from Allstate. I am just surprised to discover recently from my credit report that the hospital has referred us to a collection agency. We didn't even receive a bill statement or collection notice pertaining to the account.
How can I fight a collection agency that smears my credit to collect a medical bill my health ins. should pay? The collection agency contacted me and to show them that they should have been paid by now, I faxed them the health insurance approval form that authorizes the medical procedure for which I am asked to pay. My health insurance agency should have paid the bill of $750. Even though the collection agency knows who to contact to be paid, they decided to come after me. I guess it's easier for them to come after me, then to fight another agency to get paid. Can I take them to small claims court to take the credit report off my credit history and force them to stop coming after me? What if I ignore them? What will they do? What is next for them? What does disputing this claim involve? Anything to guide me with? FYI, my credit score was something like 775 before this incident.
Why should collection agencies be allowed to place medical debt on your credit report? If you have never paid a credit card or mortgage payment late and have perfect history otherwise, why should your credit score be effected by thousands of dollars in medical debts. I have health insurance but because of my medical condition and a child who was seriously ill after he was born, I have more debt than I can ever begin to pay. There were also numerous errors in the bills. I could never begin to pay all that debt, I barely make it now. Is it fair? I would have a perfect score otherwise! I tried paying 10.00 a month on some of them and they still turned it into the credit agency. Very frustrating....no wonder the economy suffers. People are overwhelmed with health care cost and lower credit scores. You can't get credit!
medical bill & collection agency? I missed one medical bill 9 months back, and recently got a letter from a collection agency. in the letter, they ask for the medical balance of $35 plus 6 buck interest plus 50 buck collection fee. so I just paid off the balance of 35 dollar directly to the doctor one week back. now should I pay the collection agency 50 dollars or the interest? thanks,
How do unpaid medical bills that was sent to collection appear on your credit report? I have some questionable medical bills that went to collection. They are small amounts. I did not pay them because I told them that they are supposed to be covered by my health insurance. Then I started receiving letters from collection agency. I still did not pay them and reiterate that they are supposed to be covered by my insurance. This bills was about 3 years ago. Will this affect my credit score? I don't see anything on my credit report about medical bills. Only credit cards and car loans.
How to write a letter to a medical collections agency? Do I ask them what the bill is for then tell them how much I make then ask for proof of the bill and how do I get them to erase it from my credit report The bills are a year or two old and most of the places don't have phone numbers so should I just write a letter saying how much I make or what
What are my rights as far as Medical Accounts sent to collection by mistake? I was set up on a payment plan for a medical bill. I found out one day that my account was sent to collection agency and that it was reported delinquent to the credit bureau. The billing department said it was a mistake but it happened because I was late on one payment out of ten. I didn't receive notification about this in any way and they say that I was suppose to receive 4 letters before my accout was sent to collection. They said they cannot do anything about it. Now I have an account reported in my credit report and I'm in collection even when I continue on their payment plan and I been paying diligently. What can I do since they do not return my calls and they give me a different excuse every time I call them.
Collection Agency/ Medical Bill question? Please help? A lab testing place somehow got a completely wrong address for my health insurance.. and now have turned me into collections. They have called me a few times and its always a recording and its half way done with. What do I do? Call the collection agency or the lab testing place? They need to submit the bill to my CORRECT insurance. Will they still do this even though its gone to a collection agency??
Medical bill has went to collection- Best way to show payment on credit report? I am in the process of paying off medical bills that went to collections. I have read other post and see that it does not hurt to ask for a deletion upon payment. If the collection agency is against doing this, what is the next best thing to ask for. I was unable to pay them because I was off of work on unpaid maternity leave.
Can a collection agency report me to the credit buerau for unpaid medical bills? I do not have the money to pay for a medical bill, that was a result of a crime commited, can I get reported for unpaid medical bills? What are my rights? I live in Texas
Can a collection agency add a fee on top of your original bill if it is a medical bill? I got a call from a collection agency stating that I owed a $177 bill for an Urgent Care visit apparently from last year. The original amount was for $120 which I said I would pay, but they said they charge a fee and I'm responsible?!? I've never heard of this before!
Can debt collection agencies refuse to set up a payment plan with you if you are trying to settle a debt? My sister became seriously ill and had to have emergency surgery. We did not know it but she was grossly underinsured and is now looking at $44,000.00 in outstanding medical bills. The debt has been given to a collection agency has refused to agree to a payment plan with her saying that she needs to borrow from her bank. My sister makes about $23,000 a year and does not qualify for a loan that large. I told her to just start sending them payments and keeping receipts or her cancelled checks and calling monthly to make sure they received the payments and noting who she is speaking with, that way if they take her to court she can produce something showing that she is making an effort Is there anything else she can do? We definatley don't want to stiff the hospital but we were shocked when we found out the type of policy her employer had provided only covered room and board and not the actual care.
Can a collection agency take legal action even if you are making payments on a medical bill? My adult son was unable to work for several months following his illness and hospital stay. He required extensive care from home health for about 3 months. He finally went to work and started making payments on his hospital bill each month. The hospital has turned his balance over to a collection agency. They are now calling and offering a reduced amount to settle or asking him to agree to pay a monthly amount that is more than he can afford. He has a 7 year old son to support as well as trying to save enough money to move out of my home. I would appreciate any help in answering this issue. Thank you.
Medical bill turned over to collection agency...? ...I've been making payments to the collection agency. Can I claim that as a medical deduction on my tax return? (It will exceed 7.5% of my gross income).
medical provider was supposed to bill my insurance, but sent bill to collection. how I get it off credit report? A medical provider was supposed to bill my secondary insurance for a portion of a bill. I never heard from them again, and now all of a sudden, the bill is sent to a collection agency instead and is showing on my credit report. How can I deal with this so that it is removed from my credit report, since the provider had accepted to bill the insurance, but never told me that the bill was not paid before sending it to collection?

Being sued by collection agency for medical bills help!!!!!? My husband and I came home the other day and found a folded note in our door. It was a summons to appear in small claims court for 400 in medical bills + 400 for attorney fees. We pay or bills and do have a hard time paying what insurance does not. We pay 900 per month for family benefits. This is huge to us we have never been to court. My question is. Can we call the attorney and work out a payment plan before the court date? Can we ask him to take a settlement? Are we responsible for paying the attorney fees for the collection agency that hired him? I am so blown away. We can pay the 400 for bills. Thanks everyone. This has been one hard week. But at least alll my kids are out of school and we can now play and have fun. Our court date is july. 3. Smiles,Angie it has an embossed notorized seal my husband says. I have not seen it. could it still be fake. I think we will call and offer a total of 250. what do all of you think? all fo you are so kind for helping. we live in indiana
Could anyone answer a medical debt/collection agency question? I was just contacted by a collection agency requesting payment of $3,400 from back in August of 2007. It was apparently a bill from my 3 day stay at the hospital when my son was born. I had a minor surgery 1 day after his birth and it is a bill from my OBGYN for that surgery. I have documentation for the hospitals part showing that it was paid off in full. I honestly did not know that there would be a separate part for the physician; I assumed that one bill would cover all of the costs. Several weeks before my sons birth, I supplied the hospital with my insurance info during pre-registration. I knew my insurance would not cover everything from the beginning. Within a few weeks of coming home from the hospital, I received several bills from the hospital and stopped by my OBGYN's office and paid off everything that was left owed. Or so I thought. The collection agency is claiming that I never paid for the physicians portion for the surgery. That it was separate. I now understand that almost everything is separate when you have a hospital stay but I have heard nothing since 2007. I assumed that everything was taken care of. The bad thing is the OBGYN is retired and no longer in practice so I can not contact him. I asked the collection agency why I had not been contacted earlier and they claim that they just took over my claim in February of this year!! They also said that they sent an invoice to my old address in June. We just purchased our home in October so it did not make it here. The collection agency also asked why I had not called to change my address with the OBGYN but he is out of practice so I had no reason to call!! I now also am with a different insurance company as we combined to receive a discounted health and homeowners insurance when we bought our home. The collection agency is being so rude to me and will not offer any help or suggestions. They are saying that I have too many excuses but out of all honesty, everything is true. What can I do?? I do not think I should have to pay this because I was not made aware of this for 2 years! Now I no longer have the money to cover it as I did back then. I have nothing on my credit and all other debt is paid off so I do not want this on my credit. Please help if there is anything that can be done. Thanks!
Medical collection, Now being sued. Am I right? January of 2008 I had a tubular pregnancy and ended up in the hospital. After all that was done and I was home and recovering the last thing I expected was a collection. In August of 2008 my husband and I were in the process of buying our house and we found out that part of my medical bills were not paid by my medical coverage. We went to the collection agency to talk to them about it and they said we should call our insurance company so I did. After I talked to my medical coverage provider they told me that they had not paid certain parts of my care because I had not specified a primary care provider but that I could over the phone and then the medical would pay the bills. I got a summons today from the collection agency that I still owe $500 dollars and they are suing me for it but I never received a notice from them regarding the issue after I spoke to them in their office. I asked them specifically if they needed to contact me for any additional problems or information to do so by mail. I never received anything so I presumed everything was taken care of, until today. I found out about the initial $1500 dollar debt, not from a letter from them I forget how, and when I went to the office they said they were going to mail one to me, for the original $1500. But after they put it on hold and my insurance paid most of it, they never once contacted me regarding a remaining balance. According to the Fair Debt Collection Act they are required to give notice within 5 days and to include the amount, whom the debt is to and options to resolve the issue. I never got that, except for the original amount. It doesn't seem quite fair for them to be suing me when they never once attempted to contact me, even via phone for me to request in writing. I feel their practices are unfair, responsible and have no consideration for my rights as a consumer. Had they even attempted to contact me I would have made well on my debt but they did not. This is very stressful. irresponsible, not responsible. Last paragraph. Thanks! It is named from a court. I am not trying to "delete" the debt, although I still do not know there is a balance, and am willing to pay it, when I can. I just dont see how its fair for them to sue me when they never made any attempts to contact me in any shape or form. With it being a court document I presume I need to go to court or something. I wrote out a letter of defense but I just dont know where I stand completely =( I feel they should be required to contact me before just suing me.
How can I remove a collection that has already been paid? I had a medical collection that was almost 7yrs old and it has recently affected my credit score. My score was at 724 and has dropped to 629 due to the collection being sold to a collection agency. As soon as I was aware of it affecting my credit score I called the agency and paid it. How do I remove it so I can get my score back? Am I out of luck because I have already made the full payment?
should i use credit card to pay off medical bill to avoid collection agency? the medical lab billing me only has a payment plan of 1 full payment ($1700) or 3 payments ($566) a month ...cannot afford either ...therefore it will go over to collection agency...if I pay it off in full through agency it still shows up on credit report as a debt paid to collection agency whereas card just shows high debt...????...

I am looking to consolidate my debt, its around $4000, excluding my school loans, which are deferred since I am still attending school. Where can I go to get things straightened out? I have around $1000 in medical bills and $800 in a wireless bill the rest are credit card bills. Is there anything I can do about the medical bills since I now have insurance? I have a medical bill that is 1-2 months past due before I paid it and it was sent to a collection agency? Is this old enough to negatively affect my credit report. I was told it has to be 12 months old.
Medical Collection Question - PLEASE HELP!!!? We are applying for a home loan and discovered that there was a medical collection placed on my credit 12/08. I called the company listed and discovered the charges stemmed from the delivery of my son in May of 2007. Apparently the hospital had an old address, and that's where they had been sending the bills. I never received the bill, nor did I ever receive a phone call. I had not lived there for over 2 years when I had my son. I was in the hospital for a week and gave them all of my current information (multiple times). I never once gave them my old address. I spoke with the collection agency as well as the hospital and both are claiming there is nothing they can do. These are charges that my insurance did not cover. They are saying that, since they sent it to the address on file, it is not their fault I never received the bill. She also mentioned something about how the post office should have been forwarding my mail (the post office does not forward mail after over 2 YEARS!!!). I am not unwilling to pay the charges (they are only $41), I just want it off my credit as I do not feel I am to blame for the unpaid bill. Any advice on where to go from here would be GREATLY GREATLY appreciated!!!
Collection agency has about five medical accounts, but wants us to pay all of them? We have about five small medical accounts with one collection agency. We are wanting to pay them off a few at a time. This agency keeps telling us we need to pay off the entire combined balance before they will report it as paid to the credit agency. They are listed on my credit report as single items. They are small...one for $165, another for $54, another for $217, etc. Why can't I pay them off a few at a time? My plan was to pay two this month, two next month, etc. Are they allowed to combined accounts and come at you for the entire amount? Half of them we didn't even know about! We were shocked when we heard about them all. We just want to clear it all up as soon as possible, but times are tight (I know, typical story) so we are just doing the best we can.
how do i fight a medical collection/bill that my insurance would have paid? My doctor submitted invalid/outdated codes to my medical insurance company and she billed my insurance after 15 months from the date of service. some of the claims they denied because of timely filings and they requested corrected codes on others and sent her 2-3 request letters on each claim. i even requested the from her in person. because she is a flake, she did not submit anything to them and has now sent the bill to a collection agency. she has inflated the bill and has included dates that I never saw her on. I was told that she is required by the california chiropractic board that she must be accoutable for billing within 12 months and cannot be irresponsible for submitting late bills and inccorrect/invalid cpt codes. I have already sent the collection agency a dispute letter and request for validation. they sent back a computer bill with incorrect dates, amounts and invalid codes(they expired in 1999). does anyone have any advice to how i fight this now????

Statute of Limitation on collection of Medical bills? I had a bill for a hospital visit back in april 2004, I have just been served to pay this bill i forgot i even had..( its a whopping $240. i am sure they have already written off) isn't there a statute of limitations on how long this collection agency can file a suit against me?
What do I do about Collection Agencies that completely ignore me? I have a credit agency (NCO) that their only answer to me is pretty much ummm...............I don't know Goodbye. Yet they are the only things on my credit that is causing it to be were it is at. I just want an honest answer out of them is there anyway to force them to comply and get rid of it or even update the Credit reprot to say PAID. Also is there anything against Medical Bills from being on your credit or any kind of laws they have to follow other than FCRA
