Bankruptcy Law?? I have a vehicle which is listed on my Chapter 13. But do I get the title to the vehicle when I finish paying the Bankruptcy Court??? How & when??
In Bankruptcy law in what cases could student loans be included? I live in Ohio and my husband and I are filing bankruptcy. I was reading about bankruptcy laws and saw where it said that student loans could be included if the judge ruled that it would cause undue hardship. What does this mean, and when is it considered an "Undue hardship"
How different is the new bankruptcy law from the old? I am considering filing bankruptcy due to the fact that in the last year i have willing foreclosed on my home and now it looks as though I am going to have to do the same with one of my cars, and I am just wondering if it wouldn't be better to file bankruptcy since my credit can't get any worse than what it already is, and that way I could have a chance at starting over fresh.

Are divorce law and bankruptcy law lucrative fields? I have heard that some some lawyers have made very good money in divorce law and/or bankruptcy law. They will advertise that they will "do" a divorce or bankruptcy for a few hundred dollars and then many people will call in for their services. I have also heard that divorces and bankruptcies are usually not too complicated. Any information would be great - I may be very misinformed.

Under current bankruptcy law, are retirement accounts dischargeable? I am going through a divorce and working on a settlement agreement which must be payed over a period of a few years. My father in law wants to file bankruptcy in georgia can he do it on just one thing, a car? My father in law is almost 70, he and his wife do not work live on social security and disability they have the house they live in and a rental property. Bankruptcy law in California? I am thinking about filing chpt 7 bankruptcy and wasnt sure about the law. If i do file, does that mean that all my debts (credit cards ect) will be wipped clean or will I need to pay this back? How does that work? I just lost my job and there is NO WAY i can pay off my debts for who knows how long it will take to get another job. It seems chapter 7 would be the way to go. bankruptcy law with boat as asset in fl? i am filing a chapter 7 and understand that i have to give up most arrests including my boat. what i want to know is if i give up the boat do i also have to give up my boat engine. the only title that i have is on the hull and trailer. the boat isn't insured and i don't owe anything on the boat. can i then keep the engine?
Are public records pertaining to Bankruptcy laws permanent? I already know that the credit companies no longer report about it after 10 years but I wanted to know about the public records made by the court of law. After 10 years, can credit card companies (or who else, do you know?) access the public records and not the credit report. Also I heard that things like social security numbers attached to bankruptcy cases are made public in the public record is this true? Has anyone had to file bankruptcy since the new law went into effect? I live in NY....and have had some unfortunate financial difficulties, and very well may have to file. Does anyone know how to list a law suit as an asset in a bankruptcy case? I have a pending lawsuit but do not know which schedule to list it on in a bankruptcy case. The bankruptcy is over, but I now have an adversary proceeding. The other side says I should have added the lawsuit to my bankruptcy since its open for the adversary proceeding. I know I need to schedule it as an asset, but their are schedules a - j for assets. I need to know what schedule to use for lawsuits pending. Its an adversary proceeding I am winning. Help with Bankruptcy Law? How do you figure this out? If you try to file for bankruptcy, ,You first have to get a letter from a creditor who is going to sue you. So if you don't get a letter what do you do next.? This law is fixed for the rich only since they have rich friends who will send them a letter to be able to sue so they have no problem in obtaining the requirement needed. But what does a poor, midleclass person do?

Need help with bankruptcy law?? My uncle filed for bankruptcy Chapter 7 back in 2001. He and my dad were partners in a business wich they just sold last week. My dad just told me that about 20K will be offset because of my uncle's previous bankruptcy filing. Why does filing bankruptcy override court judgments, why does the law allow this? For example, a plaintiff wins in small claims and the defendant files for bankruptcy. As I understand their slate is wiped clean and no longer owe the judgement, how is this justified? Obviously it's a cop out, but why does the law allow it, what's the laws justification for allowing this? Why can someone file bankruptcy and still owe child support but not owe a court order judgment?

How to protect my to-be-ex-wife - file bankruptcy before or after divorce? I am failed financially and about to seek protection under the bankruptcy law. Divorce/Bankruptcy-law savvy guys and girls, can you help? First, the basics: I got married in Alabama, and now live in Georgia. I have been married for 4 years, and separated for two of those awful years. One year after we separated, I filed chapter 7 bankruptcy, which has recently been discharged. We are in the process of drawing up divorce papers, however, my soon to be Ex claims that because I did not include himself as one of my creditors in my bankruptcy, that he could try to collect the debt that we have accumulated together over the years, which he now is solely responsible for. what is a bankruptcy reaffirmation agreement? and is it required by law in the state of Tennessee? me and my husband just completed a chapter 13 in august 2008. our lender CITIMORTGAGE.reviewed our bankruptcy court docket and has confirmed that a reafirmation agreement was not executed before the bankruptcy discharge was entered on or before we filed. CITIMORTGAGE said under the bankruptcy code, a reaffirmation of debt is not valid unless all of the requirements under bankruptcy law are followed. among other things, this included of filing a fully executed reaffirmation agreement (signed by all parties) with the court before discharge. so CITIMORTGAGE lien remains on our home..i call my lawyer and ask him about the reaffirmation agreement and he told me that reaffirmation agreement in the state of tennessee is only required in a chapter 7 and i and my husband filed a chapter 13...when i tried to talk to CITIMORTGAGE about this they said i am required...i dont know exactly were to go from here...my lawyer says no and citimortgage says yes....is there anyone out there that can explain to me about a reaffirmation? and who is telling the truth and what should i do because i dont know where to start to get this lein off my home and how to go about aquiring the reaffirmation agreement if im actually required.
Does anyone know how to keep your car in a chapter 7 bankruptcy? My husband and I are filing joint bankruptcy pro se (self filing). He has a old truck we own free and clear. I have a car that is worth about 4000 that I owe $300 that is past due on. I know we are only allowed $1250 for a vehicle. Is that each or total? How exactly did the bankruptcy laws change? I am not considering bankruptcy; I am not in a position where I would need to do so. I am just curious. I was trying to explain to a friend that it is a lot harder to file for bankruptcy now than it once was, but I don't know what the change was.
