How does the debt collection process work on an unsecured loan? I am 105K in debt(mortgage, student loan, car and the unsecured loan) and lost my former job due to lack of work. I got a new job but I am out 15K/yr. Through much juggling, I am paying off everyone except the unsecured loan on which I am paying 30/month(they want 260/mth) and they are unhappy I am paying them so little and threatening to sue me. I am trying to sell the house to pay off the mortgage and the personal loan and this is still at the original lender level. I am hoping I will get to work with a collections agency first since I can offer them the 30 I am now paying the creditor and when I sell the house I can pay the bill in full and have the credit bureau remove the blotch from my credit by showing evidence of payment. Do they go to collections or sue first?If they do sue,will they garnish my wages or freeze my checking account(no savings) or both? How does the debt collection process work on an unsecured loan? Tried debt consolidation but my house is not worth enough to do it and having other debt attached to it would reduce my chances of selling the house and paying off the mortgage and the personal loan. I am really looking for info on how the debt collection process works,not how to get out of debt. I have that part figured out unless I get sued. I am paying everybody except for the unsecured debt (to preserve my assets) and paying this unsecured creditor 30 a month hoping to sell my house to pay of the mortgage and the unsecured loan which will get rid of 64K off my debt and put approx 4 K in my pocket to move to an area with a better pay labor market. I am trying to find out (by learning how the collection process works) if I am going to have time to get this done before I have to worry about their coming after my wages and/or checking bank account. In other words, if I can work with a collection agency to which I can offer payments and pay the 30 I am now paying until I can sell the house. I already tried debt consolidation and I can't get a loan for 105 K with a house that is worth 79K as the only collateral. The rest I owe is my car and student loans which must be paid or they will be worse than this creditor. BBOYBALL: My mortgage is in perfectly good standing since I pay that before I even buy food. It is the only assett I have and I want to move to an area where I can work without having to commute an hour to do so. That is why I am selling the house: to move and to pay off the mortgage and the personal loan I took out to buy a new furnace and remove asbestos. I am willing to sell for 76K.
What is the collection process of bad debt and next time how to recognise these kinds of people? One of our co - worker cried about his family problems like mother's ill health, son's education etc etc and asked a good amunt of money as help on returnable basis. However, after getting his share of help, he became unresponsive and slowly it is turning into bad debt. The worry is the change in our perception to help other people bcos of his bad habit of not paying the dues on the time. Hence to safeguard self, this question. We have decided not to argue, ask and confront him.
debt collections process…best way to proceed.? last year, i became ill which lasted for a little over a year. being a freelancer, this meant i was not able to work and draw an income as well as being unable to just deal with the everyday things, including working things out with creditors. as a result, i couldn't pay unsecured debt and/or credit card bills (about $45K). when i recovered and was able to work again, my unsecured debt had gone into debt collection. in the past month or so, i have started getting calls from what appear to be law offices in regard to the debt. i'd like to know what the next steps will be in the debt collection process and what my best course of action would be in trying to resolve the debt. i have been paying all my bills (mortgage, car, utilities, equity loan) except for what's gone into collection—barely—and can't see being able to make other payments till i get a job at my level in my industry (which will take some time given the recession). how does—and how long—will this affect my credit rating?
In Iowa, how long does a law office have to serve process papers for a debt collection case? About two months ago I received a letter from Litow & Pech, P.C. saying that I owed money for a past debt for a cell phone bill and they wanted 650 dollars or they would take me to court, I didn't think to much about it because I was in the moving process and also in school full time and working full time so I put it aside thinking I would take care of it later. Well today I was told by a neighbor that someone was by to serve me papers so I am assuming that they are related. I also checked the Iowa Courts Online website and I found that small claims papers have been filed by Litow, Charles with CONVERGENCE RECEIVABLES LC on the long title. I'm not looking for smart alec remarks like "pay your bills" or things of that nature at this point I'm wondering what to do about the court case and how long do they have to serve the papers. This bill is also set to fall off of my credit report in October 2010, not sure what to do now. Thank you. Okay, but how long do they have to serve me before the courts won't hold the case anymore. I can't duck and weave them for 4 months till it drops off. It's 60 days for anyone that comes across this looking for info, I found it on this website - http://www.peoples-law.org/family/divorce/Frequently%20asked%20ques.%20about%20service.htm it reads as follows: What Happens if Service is Not Made? There may have to be several attempts to serve the other side by using different methods. A Writ of Summons is only good for 60 days, this means you must have the other party served within those 60 days. You will have to ask the Clerk of Court in writing to issue a new Writ of Summons if the other side has not been served within 60 days. You may be able to file a motion for Alternative Service (DR 70) if you cannot locate the opposing party. If several attempts to serve the other side have been unsuccessful you may have to consider serving the other side through alternative methods of service such as Posting or Publication. Im ready to payoff credit card debt, do i pay the company i owe or the collection agency that calls me? In the past three years i had a couple credit cards that i defaulted on, they proceeded to the collections process, but know i am ready to pay them off. Which would help my credit the most paying the companies directly (Capital One, Wells Fargo Visa) or is it ok to cut a deal with the people that call me all day from weird named collection agencies that now own the debt.
Can a collection agency charge more for a debt than what you owe? I am in the process of settling my debt. A collection agency which bought my account is charging more than double what I owed. The collections process- in debt.? I am about 200K in debt (failed business) all financed with various Lines of Credit, CC, etc. My wife has fine credit, and will be unaffected by this. If a credit card company wins a debt collection arbitration, what happens next? My wife received an arbitration letter from NAF stating that she lost her arbitration. This was two months ago and we have not heard anything from anybody. We do not understand this process and was wondering what do we need to do next? Do they send us a bill? What is the process for "debt settlement"? What is the process for debt settlement? I understand that when ur sent to collections ur able to settle the debt with them for a fraction of what u owe. But before that, will u get harrassed by all the calls from the bank about the missed payments? Can the bank sue u? Can they put a lien on ur house or car or take it away from u? Debt collectors harassing and rude ? Hello all , here is my question I received a call from a collection agency Wednesday which kind of shocked me plus she was borderline rude etc no real rude best describes her. She said I have a balance with the VA state tax for tax year 1996 the amount is $1740.00 ok This is the first i became aware of this issue on Wednesday past I had cancer back then was married etc.. So I called the Va tax dept she noted my account and is mailing me info re the debt I am not working now also due to this economy . Then today the collection lady calls me askes if i am going to pay i said i am waiting info and paperwork from the VA DEpt of taxation she said she didnt care and was going ahead to get the money in whatever ways she wishes I do not have property etc and have money in the Bank what can they do ie i heard about it Wednesday she said they are proceeding with collection action Please advise oh the tax return was a joint return for the state not the IRS I also have a credit with the IRS for $3200.00 as i filed an amended return they accepted it so wow but they have not sent me a check just shows i have a credit on my account .. Being Sued For Medical Debt + Process Fees? Husband owed a medical debt for $320. The collection agency contacted me and pulled my credit report trying to collect from me since they couldn't easily find him. Why they added my name I don't know I filed a bbb report against the collection agency for running my credit without my permission and adding me to his account. I didn't sign any papers with them, they told me they didn't need my permission to run my credit. In Feb my husband and I got our finances together and started paying $50 a month on this bill. We mailed them a letter stating that we were going to pay $50 a month to them. We get a letter from the hospital's lawyer saying that we need to pay on this or they will sue. I sent a letter back informing them that we are paying $50 a month. We had made only one payment but we were paying on it. I also cc'd letters to the hospital (original creditor) and the collection agency. Today we got served court papers. On our last receipt from the hospital it indicates we own $230. I called the collection agency today and with court fees / process server fees we now owe $387.79; which is higher than the original hospital bill which was $330.00 We are due to go to court June 1. Our last payment to them under our $50 a month plan would be May 31st. I called them today and asked why did they sue us and we contacted them to inform them what we could pay per month. He told me that they sued us because they didn't have anything in concrete that we were going to pay $50 a month; all while telling me that they did receive the letters we sent out. And can see that we've made 2 payments. He then offers me a 20% discount on our balance of now $387.79 (balance + 157.79 process fees) saying the only way he can offer it is that we agree to give him permission to automatically debit our checking account / credit cards ...I told him no... I believe they are suing us because that's how they wanted payment arrangements in the first place. I AM SO SORRY THIS IS SO LONG. I know 2 more payments of $50 don't add up to our balance of $230. We are doing the Dave Ramsey plan so we will pay $50.00 this month (April) and the end of May we will pay $180.00
Credit Report Bad debt/collection? I've been working on paying off collection agencies and debts and cleaning up my credit report for about 3 years now. I finally have all but one debt settled (in the process of validation on that one) and now I'm trying to tie up loose ends on the credit report. I have anywhere from 11 to 14 accounts listed on my report depending on the report. Most show "Pays account as agreed" as the status and show a balance of $0. However, a few of the settled accounts show the $0 balance correctly but a status of "Bad debt/collection". Shouldn't they show "Closed" or something since they are settled and paid in full? Or do they keep that status indefinitely? If these should be corrected, do I contact the credit bureau, the collection agency paid, or the original lender? Here are examples: Descriptions: Paid charge off / Student Loan Balance: $0 Current Status: Bad debt/collection Descriptions: Settlement accepted on this account / Paid account / zero balance Balance: $0 Current Status: Bad debt/collection
As a victim of identity theft, do I have to assist a collection agency in the prosecution to clear said debt? A collection agency has provided me with an ID Theft Affidavit which has an option that asks if I'm willing to assist in the prosecution of the person committed the fraud. I have no idea who it could have been but it took place in MD and I live in CA. If there is a prosecution, I don't want to be hassled with it. I called the collection agency and they say they will not clear the debt if I do not assist. Can they do that? I don't know the laws related to this stuff. I've been battling this collection agency for the better part of 2 years and it seems they are able to dictate the process without having to be constrained by regulations or good judgement. Can I get out of paying a CC debt to a collections agency? A process server came to my door last year with papers to appear in court for a debt collection. I attended that one and making monthly payments. She advised under her breath to tell the court that have "psychiatric problems and do not remember any charges made", etc. She said to tell them I was seeing a psychiatrist and cannot remember using the card. Is this true? This was a process server!

what type of proof does a credit collection agency have to show to validate a debt? I dont think that a simple printout that anyone can make up should do. How long does it take to get a Debt collection Refund? I paid off a debt to a debt collection agency and made a double payment by mistake. I immediately asked for a refund when I found out later that week, and the refund has been in process for 2 months! I've been calling them every week to ask them the status for the refund, but they always tell me that they are "not sure" when it will be finished processing and when i will get the refund back. Does anyone know if there is any way I could speed up the process or if this HUGE DELAY is normal? I am really in need of the extra $1000 I paid.
My American Express debt just sold to collection agency. They want full payment.? My blue Amex account just sold to collection agency, to my surprise - website still showing account there. Very rude collection rep contacted me yesterday - my first knowledge that the account wasn't with AMEX. Very rude man. I am so honest and willing to take responsibility. What if we can't structure a repayment plan? The card is in my name, but I understand that my husband can be contacted and his wages can be garnished. I have never asked a more serious question....please read and advise! (debt collection false accusation)? My boyfriend is currently in the process of buying a house. His credit score used to be great (upper 700s) but the lender just called him to let him know that His credit score dropped because Verizon Fios put a complaint on him for not paying for the rental equipment. This property is very competitively price and he was planning on putting the offer in tomorrow. He said that he did get a letter from FIOS a few months ago but he checked a box saying that he disagrees with the complaint and that he had not heard anything since then. Do we contact Verizon Fios directly? He thinks we have to go through the debt collection agency but that could take so long. The rental equipment was turned in sometime around October of 2008 (in case that is important). He has evidence to prove that he canceled the account properly but he didn't keep anything from the day he actually returned the equipment. But I was there with him so I know it was returned. Please give us some advice on how we can handle this quickly. This couldn't have happened at a worse time. Any honest advice would be very much appreciated and in the meantime I will try and surf around to find a number to call. THANK YOU.
Can I put a lien on a vehicle for debt collections purposes? This is in the state of Minnesota. I have a small claims judgement against someone. I recently found out that he has gotten a vehicle (that was not used as collateral for the money I lent him). The vehicle is titled in his name only...even though I am sure his girlfriend paid for it. I am wondering if there is a possibility if I could put a lien on the vehicle for purposes of collecting this debt. I am in the process of finding out if there is currently another lien on the vehicle.

IS this legal? Debt Collection Threats From ONE person at a dealer? Hello to every attorney reading this. I purchased a 1999 Subaru for a huge amount, which is my fault. Story goes that I lost my job and could not mak my payments. I was 90 days past due at one point in which I received a repo notice, that was understandable. I owed about $1200 made a payment of about $800. I now owe $753 and thats less then 90 days past due. I am waiting to receive check since I have now been employed for approx. 6 months. I planned on paying the over due bal on the 20th. I was hoping to pay $500 so that would leave me $253 to pay until the next payment of $328 is due on the 28 of this month. I just received a letter that was typed by a female I've been talking to at the dealer, it is unprofessional, threatening, and I feel doesn't follow the FDCPA, if the dealer is even liscensed as a debt collection. The letter explains that if I don't pay the past due bal in a certain time they will proceed to collect the funds which I'm sure means a suit and repo of car. Read it and contact me if you believe something can be done. LET ME MAKE IT CLEAR THAT THE PAST DUE BAL IS AN AMOUNT I INTEND TO PAY but if something illegal was commited by the dealer I want to know and do something about it. People owe money every day and as soon as a debt agency tries to take advantage and scare the consumer THE FDCPA is there to back them up. If theres nothing wrong then thats fine too. After talking to her and having her give me an attitude she decided to make her own letter that reads: (written as it is including grammer and punctuations) Date 01/13/10 Total (Full amount of car shown here) THIS AMOUNT DOESN'T INCLUDE LATE FEE'S Dear Sir or Madam: We have not heard from you regarding your Past Due Balance of $752.88. This balance is extremely over due. If we do not receive payment in full with (10) ten days of the date of this letter, on your account. Our office will processed to recover out investment. We have tried every attempt to collect the debt. In addition, you have failed to contact our office. Therefore, you have left our office no choice but to proceed with legal action agaisnt YOU if this matter is not resolved. You are responsible for all court cost and attorney fees. can a person file a chapter 7 bankruptcy on a debt owed to the ky lottery ? I know a guy who was leasing a store, the guys he was leasing from decided to sell the store and he was in debt to the kentucky lottery about 23,000 dollars, the ky lottery has threatened to take his home and personal belongings to get this money back. He has a wife and three kids,and has about worried his self to death over whether he can get this debt discharged or is he going to lose his home and etc. over this. He has a loan he is paying on that he took out on this house, not only does he owe 23,000 to the kentucky lottery he owes 20,000 on the loan against the house. I have tried and tried to find answers to this, but so far no one has helped out much. His attorney wants to try and stall the collection process of the ky lottery, but he needs to know if he should go ahead and file on the house rather than to reaffirm it(pay the loan on the house) or if he should go ahead and file on the house cause he is going to lose it and owe the money to the lottery anyway.
How to Interpret This Eeery Silence Regarding Collection of Debts? 2009 was “Debt Hell” for my wife and I as we defaulted on numerous Credit Card accounts and learned more than we EVER wanted to know about the Debt Collection and Debt Settlement processes. As things progressed in 2009, most of the accounts were handled by the original Creditors in a similar manner: constant calls and letters from the original Creditors for this first three months, followed by charge-off, followed by constant calls and letters from Debt Collectors working on behalf of the original Creditors, a few lawsuits that never made it to court, and eventually settlement or payment plan agreements on all accounts EXCEPT FOR TWO. These last two accounts have been in default for just over a year and the silence from the original Creditors and the Debt Collectors continues to baffle me. First of all, I have indirect evidence that the Debt Collectors that contacted me regarding these two accounts were working on behalf of the original Creditors and have not purchased the debts. Account #1 (Value slightly over $10,000)- I never received ANY correspondence at all from the original Creditor nor any Debt Collectors, and just a few phone calls from a Debt Collector late last summer. And I recently found out that this account was originally with a Debt Collector who I had a lot of trouble with on other accounts with this same Creditor, but for some mysterious reason the original Creditor recalled it from them in early spring 2009 (it got recalled just before this Debt Collector sued me on behalf of this same Creditor on several other accounts). Account #2 (Value in the vicinity of $50,000)- I got the standard letters and phone calls from the original Creditor, then the same from Debt Collector #1, and then exactly ONE letter and no phone calls in early fall last year from Debt Collector #2. And then nothing. I requested Debt Validation in response to the letter from Debt Collector #2 and have not received ANYTHING. What am I to make of all this? Why am I not getting hounded with letters and/or phone calls? Why have I not been sued? WHAT AM I MISSING?
What can I do if a law firm is harrasing me at work for debt collection ? Peachtree law has been harassing me for the last 3 days. They have been calling my work numerous times a day after I've told them I can't take personal calls here. They are trying to make payment arrangements for a debt collector. I even explained to them that I am in the process of filing for bankruptcy and i will NOT be making arrangements with them, yet they continue to call. It's absolutely out of control and now everyone at work knows about it. I just got done filing a complaint to the FTC hoping they will do something. Are they allowed to harass me like this??? What else can I do to stop it?? Having to go through this bankruptcy is difficult enough for me. I just can't handle anymore. Please help me.
Can they violate the Fair Debt Collection Practices Act? I posted another question about this earlier so feel free to check it. But here are more details: In 2003 we owned our own business in Oklahoma. We wanted to place an ad in the yellow pages. So we went through the process, they sent us a fax with the ad proof, and my husband "voice verified" the proof. Neither he nor I ever signed anything regarding this ad, thus making this an oral agreement, correct? When the book came out, they had put the wrong number on the ad. We had been making the preliminary payments, but stopped paying when we knew that they screwed up the ad and told them so. In July of 2006 we sold the business and moved to Idaho. Now, the Yellow Page book is trying to sue us for the remaining balance. We no longer have copies of the ad and cannot prove that they screwed it up. However, the "voice verification" occurred on August 8, 2003. That would be the date we entered into the "oral agreement", correct? They filed suit, unbeknownst to us, on August 14,2006. (We did not receive any notification until Feb 28, 2008) The statute of limitations for an oral contract in Oklahoma is 3 years, which it appears they exceeded by 6 days. Also, the FDCPA states that when filing suite regarding an oral agreement, the suit must be filed in the state where the defendant lives currently. They filed in Oklahoma even though we live in Idaho. Can we claim that they have violated the FDCPA on these two grounds? And if so, what are our chances? They have asked for Summary Judgement twice, but have not receieved it after the court received our responses. We were placing two ads for two separate divisions of the business. The ad proof was correct, but they switched the phone numbers. In the final book, they switched the phone numbers.
I Need help with a collection agency fictitious debt? here's the situation. My senior citizen friend has been living in the salvation army for about 4 months now. He will have to move by the end of August because of time restraints on living at this transitional facility. He get's a social security check of $920 that has to supply his rent and food. We went to check out a senior citizen's retirement home that is HUD and the rent is based on income. It is so nice. This is the ideal place to live for him. The Problem is that at the last apartment he lived with 2 other guys that left him with a $980 bill that he had nothing to do with. Something about the apartment manager not taking him off the lease. So, the retirement facility requires that he have this rental debt be removed from his credit report before they can allow him to live there. County Court Judgement without me being contacted or involved in the process while living in Dubai? A CCJ was awarded against me for leashold fees on 2 properties I own in the UK (less than 5K each CCJ). Throughout the whole process I was not contacted as the address they claim to have on record had changed. Now the Debt Collectors has effectively approached my bank and instructed them to increase my mortgage to recover the debt Again, the address the bank have for me had changed and I had not advised the bank. My borrowing was increased without me knowing All going against me up untill now! However the property management company who had contacted the Debt collection company had my email address, mobile telephone number and new address well before any CCJ or debt recovery company had been approached, and this can be proved as I have 2 way correspondance by email. I am not disputing the fact I owe money for the lease fees. If the managment company had contacted me on an address, telephone number or email address they had all of this would never have happened. What do I do?
If a collection agency sells an account to another, can the 1st agency be removed from my credit report? In the process of paying old collections on my credit report. On one bill I have two different collection agencies reporting. The first lists the account as date of deliquency in 3/2003 it hasn't reported since. The second gives the date as 2/2005 with last reporting in 10/2006. Both are for the same amount & original creditor. I am assuming they are for the same account & have sent (certified mail) debt validation to both. My question is that if they are for the same account and the 1st sold the account to the 2nd, then can the 1st be removed? I know the 2nd has to correct the date information so it's not "reaged". Is this double reporting?
How could i know i have been sued for debt collection ? I rec'd a summons to appear in court in 2007 for unpaid debts in the amount of $2000-$3000. The action was initiated by some attorneys who were operating on behalf of a credit card company. I never showed up and would like to find out what happened to it. Is there a way to know if the case was processed a judgment was made. Also is there a way i could find out if i have been sued by some other credit card companies too... apparently i owe debt to 4 or 5 companies around the same dollar amount. I keep moving from places to places and never even bother checking emails.
What should I do when a collection agency tries to take my house from me for a $3000 debt? Is that legal? My mother owns a house in Ny. She had a credit card debt of $3,000 which went up to $10,000 with interest when it wasn't paid. The debt was sent to a collection agency (SMS Recoveries,Inc) which is now in the process of evicting us out the house because their lawyers (Law Offices of Michael S. Samuel) say they now own the house because of the credit card debt. The mortgage on the house was not deliquent and was current. They are only offering us $7,000 to move out but we must agree within 2 days and $20,000 from the sheriffs sale. We never recieved a court date to dispute the charges. I dont know if this is legal or not.
Debt - What is the minimum amount that a collection agency will sue for? I owe $3225.00 to a credit card company. I believe that debt was sold to a third party collection agency. I have been unemployed for awhile and cannot make payments as of yet. I live in Ontario. I have not established contact yet as I am wary about dealing with a collections agency. They have sent a second notice in the mail and I am writing them to tell them I have received the letter and not to contact me in any other way other than by written letter. I need some time to find a job (probably two jobs to pay my debts as this is not my only debt) and then I will be able to arrange a payment. I want to save up a large portion of the debt and negotiate the debt as I know that they bought the debt for pennies on the dollar. I don't want them to sue me in the meantime. They are not exactly sympathetic to the fact that I am not employed. Saying that, my only asset is a car (which I need to find a job) worth $1000. What is the likelihood that I will be sued? Easy or hard process to file complaint when collection agency is in violation? For the past 2 years I have been dealing with a collection agency, I have written them numerous letters asking them to validate the debt--they never did, requesting that they never call me, my family or work, and I always respond to anything they send me in the mail. (All my letters were always sent with confirmation so I have proof). To date, they have never written me a reply letter. All I get from them is a coupon type spam letter each month that says things like "use your holiday bonus money to settle your debt now" or "use your tax refund to pay off your debt, 60% off for a limited time only", its never real letters from an actual person. Anyway, most recently, they called me and left a message. In the 2 years that they have been sending me spam, they never called until this week. I have no clue how they got my cell phone number (its unlisted and unpublished and caller ID name is removed through my provider). Since I wrote them a letter that they are to never call me, I know they are in violation of the FDCPA laws. Has anyone ever filed a complaint against a collection agency to the FDCPA? Is it a long drawn out process that never gets anywhere? Or is it a simple process and you can actually speak to someone at the FDCPA to make a complaint? And I have responded to all of their so-called letters with letters that I had proof of delivery. I've written letters that are polite, but yet demanding they do not call me or contact me and letters demanding they validate the debt...they haven't met any of my requests. How do you prevent a collection company from imposing reporting and collection fees? I made a payment to a collection company for a debt a few days ago. I looked at the balance due now and it shows the same amount that was due before I made the payment. I found out that the company is charging a collection fee and a reporting fee that has to be paid off before the actual debt can be paid off. On top of it all I am being charged a payment processing fee. I think I just should have let the seven years roll by and let the debt fall off.

If a debtor never borrowed any money from this third party, why should they have to pay them? I find that these collection agencies that purchase debts run their businesses by taking advantage of people's misfortunes many times. Also, why aren't original lenders required to inform the debtor that their debt is being sold to a third party? Process for fighting collection agencies? I recently ran a credit report and found a debt of $130 to Synovus Bank that I don't believe is mine. I want to get this debt off of my credit report and I don't feel that I should owe the money. I know that the first step is to contact the collection agency that currently has the account and demand that they provide proof of the debt, but what to do after that? I remember seeing a site sometime back that gave a list of steps you can take with collections agencies, and if they fail to meet any of the requirements laid out in these steps they are legally required to remove the debt from your credit report. Edit: I should add that I have NOT had any contact with the collection agency. I have moved since this ordeal originally happened so they may not even have my new address.
Collection Agency, bogus debt, help!? Last year I was contacted by a collection agency regarding an old Best Buy account that I completely paid off about 10 years ago. I ignored the collection agency but pulled my credit report and sure enough it was on there. I disputed the item and all of the credit agencies deleted it from my report in October 2008. I just received another letter from a different collection agency regarding the same account! I am at a loss, I do not owe this money! I am in the escrow process for buying a home and I am terrified this will now pop up again on my credit report. Can this be re-reported to the credit agencies again?

A Collection Agency that was pursuing me for a debt, Mann Bracken, has filed Bankruptcy and fired all its employees. What now? Am I to assume that: - If Mann Bracken was acting as an arm of the original Creditor, the original Creditor will eventually re-assign or sell the debt to another agency? - If Mann Bracken was acting as a third party to which the debt was sold from the original Creditor, it will eventually be sold to another agency as part of the bankruptcy process? I figure either way, it buys me some time to gather settlement funds. Does this buy me any leverage with my negative listing in my Credit Report? In other words, if Mann Bracken and not the original Creditor initiated the listing, do I have any grounds for a dispute and removal of the negative item?
More than one collection agency has sent letter for owed amount, how do I know which one is the one to pay? I read an article that sometimes a debt is sold many times, and that you have to be careful that when you settle with one collections agency that is all there is, because they sold your debt and another agency then starts the process again, putting it on your credit report and all. Process of Credit collection? On march 2008 I got a credit card and I spent $600 on it. I have been yet to pay off the amount on the credit card which resulted me a $800 fee up to date. I came in to the bank and paid off the $200 minimal deposit 2 months ago and I still own them $600. Today I got a mail from CollectComCredit with a title called "Urgent Notice" It basically informed me that If I don't pay off the rest of $600 in 24 hours they will advise their client of the most efficient method of collecting my account. I m confused on what that means and what will happen to me. I do plan on paying off the rest of the debt between march-April do I have enough time? If anyone can tell me what will be happening in the afterward and what is the deadline before they place a lawsuit on me I'll really appreciate this. Thank you.

Collection Agency Advice - What Should I Do? I have a debt that I have been disputing for about 2 years. Recently, I received a phone call from a new Collection Agency who has stated the account will be sent to arbitration before the beginning of the year if I do not pay $4000, which is close to the amount I actually owe. In the past they have been saying it was $8000. I would like to pay that amount and solve this problem once and for all.....however, I am not able to do so in the 2 weeks they have given me. Is there anything I can do to delay the process before it goes to arbitration? It seems the owner of the debt keeps switching collection companies everytime I seek verification of the debt. The current company has only been managing this debt for less then a week. They claim they do not need to verify the debt. What should I do?
Not sure how to handle debt collector (NCO)? There are 3 questions: I forgot to pay my AVON bill last month, and I received a notice from AVON saying it would go to collections. So I called AVON and paid my bill in full, HOWEVER, it had already gone to collections. Now the Debt collection agency (NCO financial systems) won't stop calling, even though I have told them I paid the bill to Avon. 1. Why is the amount of the debt according to NCO different from the amount I paid AVON? I paid Avon $53 (supposedly the whole debt). NCO says I owe only $43? 2. I am in the process of writing a letter requesting validation. The debt is in my maiden name, and 2 weeks ago when they began collecting the debt, that WAS my name, but last week I officially changed my name (with basically everywhere, including the bank, social security office, etc) and have since taken on my husband's last name. Should the ending remarks my validation request be: "sincerely [my maiden name]" or "sincerely [my new name]? 3. Last week I was approved for a credit card (it's my only credit card), and the name with the card is my new name. Debt collector problem? i recieved a debt notice from the place the debt occured and the debt collection agency the same day, the debt collector has been sending me bills for amount of debt being 13,000 i call the place where the debt occured the collection agency parent company Salle Mae answers the phone on behalf of the place and they told me i have a debt of 5000 i asked for a statement showing that 5000 is the amount, they say that the system is down and can not process that. and to call back or they'll have someone call me I had them have someone call me never happen. I called them back same damn problem month later. I asked could i speak with someone at the place and they said they can not transfer me. they said i can either wait for someone to call me or call back later or i can come in i told them iam in Hawaii and there on the east coast. everytime i call i get another bs excuse. I asked can the debt collector look into the system that There parent company Salle Mae looks into, and never got a answer. I always got we need this payment asap, Any time i brought up Salle Mae they changed the subject My question is how is the system down if were both looking at it. I called the place at which the debt occured and Salle Mae answers all there phones for them i called like 10 different numbers all said Salle Mae Answer on behalf of. I told them i want to speak with someone at the place and they said that they can not do with that because there only dealing with people in person. and that they could have someone call me from there still waiting for that call. Medical collection, Now being sued. Am I right? January of 2008 I had a tubular pregnancy and ended up in the hospital. After all that was done and I was home and recovering the last thing I expected was a collection. In August of 2008 my husband and I were in the process of buying our house and we found out that part of my medical bills were not paid by my medical coverage. We went to the collection agency to talk to them about it and they said we should call our insurance company so I did. After I talked to my medical coverage provider they told me that they had not paid certain parts of my care because I had not specified a primary care provider but that I could over the phone and then the medical would pay the bills. I got a summons today from the collection agency that I still owe $500 dollars and they are suing me for it but I never received a notice from them regarding the issue after I spoke to them in their office. I asked them specifically if they needed to contact me for any additional problems or information to do so by mail. I never received anything so I presumed everything was taken care of, until today. I found out about the initial $1500 dollar debt, not from a letter from them I forget how, and when I went to the office they said they were going to mail one to me, for the original $1500. But after they put it on hold and my insurance paid most of it, they never once contacted me regarding a remaining balance. According to the Fair Debt Collection Act they are required to give notice within 5 days and to include the amount, whom the debt is to and options to resolve the issue. I never got that, except for the original amount. It doesn't seem quite fair for them to be suing me when they never once attempted to contact me, even via phone for me to request in writing. I feel their practices are unfair, responsible and have no consideration for my rights as a consumer. Had they even attempted to contact me I would have made well on my debt but they did not. I am not trying to "delete" the debt, although I still do not know there is a balance, and am willing to pay it, when I can. I just dont see how its fair for them to sue me when they never made any attempts to contact me in any shape or form. With it being a court document I presume I need to go to court or something. Received Court Summons on $2200 Debt/ Settling Help!? I received a court summons a couple days ago for a 5 year old $2200 debt that's been sent to a debt collection agency. So far I've talked to the rep 4 times and I've offered to settle it in one lump sum of $800. He said he would call me back the same day and did not...so I called him today and he said that he hasn't herd from "them" regarding my offer and will let me know as it takes a "few days". I feel as if he's trying to kill some time as my court date is May 10th and feels the pressure will force me to offer more? What do I need to know regarding this as I'm completely clueless on the process and the length it takes to settle and what happens if an amount is agreed upon. What do I need to do to put his behind me and settle this for the least amount of money possible? I'm a college student and obviously broke. Is the process typically back forth phone tag and how long does it take to settle? I'm in college and totally broke....if I threatened bankruptcy would this help?
could debt collectors turn up on my doorstep for my debt?? (UK)? I have a debt totalling £5000 with credit cards, I haven't paid the minimum payment since November 2008 as I was made redundant. I am now with a debt management programme, I found them much more convenient, at the moment they are still in the process of negotiating with my creditors so hopefully next month, payments could be paid out to each creditor of mine. I got a message on my mobile from impact debt collection on the 2nd of feb 2009, they said they'll be calling at my home on the 3rd, i was scared!! since I live with my parents I wouldn't want them to see me going through this. But they never showed up, are they just threatening me or will they really turn up at my house?? Is a defaulted student loan rehabilitation process even possible? I have a student loan that just went into default. I was just notified by a collection company called Windham Professionals, to enter in a program that reduces and "totally erases" debt over time. Is this conceivable or just a hoax? What happens to a debt when it has been outstanding for several years & not been paid back to the creditor? I started of really great when I first receive my credit card and lately I've had some struggle with family members who stole and have her friend use it as well. Help with collection problem? I have a CC debt in collections. It was just sent to collections last month. If they will not work with me and try to sue. What exactly happens when they file lawsuit? I have been told that they can take a lein on my house (which is jointly owned and the debt is soley mine) and told that they can take my car. It is paid for (old). Need help with a Collection Agency and T-Mobile so called unpaid debt? Thanks in advance for any answer I recieve. Okay here is the deal. In November of 2004, I canceled my service with T-Mobile. I was charged a cancellation fee of $200, and the total bill I recieved was $450. I set up payment arrangements with them, for t-mobile to automatically take $90 out of my checking account Bi-Weekly. They took 4 payments of $90 out of my acount, which totals $360 I paid them. On 2/24/05 they sent me to collections come to find out on 1/11/2008. While they were in the process of taking money out of my account I was sent to collections. I never recieved any bills or notices from T-Mobile or a collection agency in 3 years saying I owed money to them. On my credit report it shows a collection account of $179.23 to T-Mobile under the collection agency's name of BCR. I contacted BCR and T-Mobile and they said they cant look up bills dating that far back in 2004. I filed Bankruptcy in 2005. If I knew of this and had recieved info from them I WOULD have included it.
Can a collection agency attempt to collect "collection fees" though the accounts were resolved via creditor? I found out from a credit monitoring service which monitors my credit that a collection agency had two collection accounts associated with myself. One collection account was for an ambulance service rendered for an accident I was involved in. I contacted the ambulance service company and my health insurance information was processed and the account was paid in full. The other collection account was associated with the local cable company. I had not returned the cable modem I was renting through the cable company when I moved out of town. The cable modem was returned and the account was closed. In both cases no money was paid out of my pocket nor was it paid to the collection agency. As an aside the collection agency and services were provided in the state of Nevada. I no longer reside in the state. Can the debt collection agency legally charge me for collection services given the situation described? What recourse do I have in challenging these collection fees? Some additional information. The collection agency is attempting to "collect" fees from me, even though I have not paid any money to them for the resolution of the charges nor have I paid any money to resolve the outstanding accounts. In one case my insurance company paid the creditor and in the other case the returned equipment resolved the issue. The question relates to whether the collection agency can legally require me to pay collection fees associated with the collection accounts. These collection fees are being reported to on my credit as delinquent. These are not "trivial" collection fees as they amount to $300.
What strategy will hasten the credit building process for an authorized user on an Amex gold card? My bro added me as an authorized user on his amex gold card so i can build up credit. I was wondering what is the best strategy to take with this card seeing that it is not a revolving account but rather an open account. I have confirmed that the card can be used as a vehicle to build credit, . I have also been dutiful in paying off recent derogatory accounts, on top of that i have disputed inacurate info(pending decission) but i have one account that i reached a settlement agreement with the collections agent but reneged on it. Now my second question is 2 fold. 1. Since i have paid off charged off accts is that good or bad because accordinf to a report of positive thing on my credit, those charged off account appeared. And 2. Does settling help and does reneging on a settlement give the collection agency the right to rereport the debt on my credit. And just out of curiosity has anyone out here raised their credit score 200+ in a span of three months? Any and all help is welcome

I'm in a long process of cleaning up my credit. Any advice on what my next step should be? After years of negotiating and payments, I've got my debt to creditors down to just over 600 dollars. This money is owed to 4 creditors; all of which are collection agencies due to bad debt. At least two of these will not come off my credit reports until 2012. Miraculously, I was able to get a gas card several months back and have been using it and paying on it wisely so it is the only current, positive credit that shows on my credit reports. Thinking I might be in luck, I tried to finance a computer through Dell but was turned down a few months ago. Any advice on what I should do next would be greatly appreciated. It's been a long road but I'm finally beginning to see the light at the end of the tunnel. If I want to pay my debts but in return I want them to take it off my report or say something good so that next time I apply for credit I won't be denied. Will it say payed in full or what? Paying debt when creditor isn't helpful? I overdrew my bank acct 2 years ago and it was closed. I have since cleaned up my act and I am in the process of paying off old debt. I have been trying to pay the bank for over a year now and it seems to be impossible. I am unable to open a new acct (making it real hard to save money) with out a letter from them saying I have paid them in full. The issue is they sold the debt to a collection agency, they then sold it to another who sold it to another. I have all the numbers and I have called each of the places but i am being told (many times) that I need to pay the collection agency who now owns the debt. That would be fine if they would answer their phones. I call the number I have for them and I am told hit 1 if I know the extention (and I do not) or 2 to speak with the next available rep. I hit 2, the phone rings for like 3 seconds and then it says the selection I made is not valid and the phone is cut off. I have even tried to hit 1 and dial random numbers, but no luck. I have called US bank (where the original debt is to) to see if they can help and I have been told no many times. I want to get this debt paid off NOW but can't seem to do it. Any advice would be appreciated. I have never recieved anything from either collection agency that purchased the debt from the bank or the first collection agency. I knew of the debt because I knew what needed to be paid. I have gone to the bank 3 times now and spoke with the manager and each time he says his hands are tied and when the debt leaves them they can not do anything about it. I even called the corporate offices (this is how I found out who purchased the debt from them to begin with) and was told the same thing. I have cash now and I am going to go to the branch again, maybe even try a different branch and see what can be done. I want to get this debt paid off and it seems almost impossible to do. However, I am not giving up I need it paid so I can open another account (I have spoken with a different bank and a financial advisor) and start saving money. what if i don't pay the LDC collection agency for a street cleaning parking fine on 2004? wasn't there a law that all debts are wiped after 5 years? I know I wrote a check and paid that fine many years ago, but I have no copy of the check that was processed though. and I did not make a delivery confirmation letter. Validating a debt? What does that mean? I have a couple of accounts (dell and capital one) that were sent to collections and i have just received letters from the collection agencies. I heard that I should write them back within 30 days asking them to validate the debt. What does that mean though and what is the process they will go through to do that? Status on your Credit Report after debt paid off.? I recently made settlements with collection agencies to pay off the debts i owed. I made them send me letters indicating that a settlement was made. I paid with electronic check debit so I have proof from my bank indicating that the accounts have been paid but i want to know what's the best way these accounts can be listed on my credit report that will postively impact my score. Can the collection agencies delete these items from my credit report after the settlement payments were processed? Also how do you get the collection or Credit bureaus to change the status of accounts, or delete accts that have already been paid.

When someone defaults on a credit card,....? When someone defaults on a credit card, after a time the credit card company will charge off the debt. Then a third party will buy the account and try to collect the account. How much does the third parties pay for these charged off accounts? Also What is the debt collections proceedure for claiming the money? - I have received several letters from them some of them contradicting - one minute they are sayin they are going to bankrupt me the next they are saying they are going to put a charge over my property. They wont except a payment arrangement and they wont except the settlement I have offered them? What do process are they following?
